Federal and state drug distribution/trafficking laws and punishments vary according to drug type, amount, geographic area of distribution, and whether minors were sold to or targeted.
i just found that the first offense is up to ten years in penitentiary, and/or a 10,000,00 dollar fine... i just got a hold of a lawyers number so more details to come i guess.
alright i talked to a lawyer, he said in kentucky class d felonys which i think i have carry 1-5 years in prison or jail
well shit.... that just sucks dude...

If there's no evidence of ecstacy (It wasn't on you or the person you handed the cash to) then they can't charge you for anything. It's not illegal to give someone money.

Yeah, that seems reasonable they would charge you with trafficing. If the cops waited until you were in the middle of the deal to bust you, then someone snitched you or the other guy out and one or both of you had been under surveillance for a while. They'll probably have phone records/recordings on you guys and reports of your movements.Quote:

Well, I talked to my lawyer today. It seems for it to be trafficking the pills would of had to be in my hand at one point, which they never were. That is part of my defense but the cop if he wishes to pursue this case farther and get a guilty plea can easily take it farther than that.
This shit is starting to get pretty complicating, the lawyer doesnt think that i will see the inside of a jail cell for this again, but im not the most faithful when he is talking about 5 year stints in a penetentieary. Basically we are going to be trying to keep this at the local level and away from the grand jury and circuit courts, at the lower level it has a greater chance of being dismissed, or possibly a better package. At the higher levels, it becomes a prosecuting attorneys actual job, and the chance of it being dismissed is virtually non existant.
If the charges arnt dismissed it is likely the Class D felony will be dropped down to a class A misdemeanor which carries a 1 year jail sentance and a 1,000 dollar fine. I really dont want to go to jail for a year with a guilty charge for whatever it is.
I need to call my recruiter tomorow and see for SURE what charges I can have and still be able to join the army, I put all my eggs into enlisting so to speak so this has really fucked me over; if I cant join then fuck mabye I can go to med school or something.

I had my court date today, I drove 5 hours to louisville to sit there for 5 minutes. We pushed the actuall date back to the 14th of may, or the '20 day date' in hopes that something may go amiss so that the charges are dismissed. Good news though, after finally seeing the citation (didn't have it at the time I first met with him), the lawyer feels much better about the case and feels that they have a weak case against me.

That makes sense. I know someone whose attorney did just that: they kept asking for continuances (pushing court dates back), that the prosecutor just said, "Screw it" and dropped the charges, because there were too many cases on his docket.

I had my court today, all charges have been dismissed! The attorney said it was just short of a miracle that it happened.
Yea court sucks, i spent 2 hours running around trying to get my money back they took and still havent got it. I need a court order for release of my personal possesion but that wont be ready for several days! grr

I got Busted in Liousville at a Dead show for sellin Nonexsitant LSD (I Had NO such thing in my hand,pockets or the car)... took them to trial...Fought like a madman..They don't like it if u fight back. Kentucky is a Commonwelth NOT a State (like Caili) Their Laws and ways of appling them are HARSH...they took it down ot a misdomeinor I told them to go fork themselves, NO Acid No Bust! all they had was a $20 Bill and the cops testimony. The Cops lied through their teeth...Still spent 9 mo in jail fightin them. I won and they Let me go...But it took all that time.
Do as the lawer says...But Remember YOU are in the Drivers Seat!!! If Your Not Guilty Don't let them try to make you cop to anything!!! they will fight back but Their System is WAY overcrowded.They have no room at the inn,this will work in your favor,stay strong All they want is your money or a conviction...Give Them Nothing!!!

1st off, they take and charge people like you, so you will cave and narc your friends out...In a case like yours, it is common that the judge will insist the prosecutor in a case with no evidence, like yours, to drop it, and not waste the courts time. that's what happened. Most likely they hoped you would roll over, but you didn't and they let you go away, rather than embarass the court with sketchy charges at best. Good luck.
By the way, If you still join the military; You better clean up your act, because, even though you can probably get away with doing a little dope from time to time...If you get caught in the military getting stoned...Your ass will be in the brig, they will bust your rank, and if you are the scapegoat, or the commandant wants to make an example for the whole base; then your ass will be in leavenworth...

Keep your nose clean. Even though you got off the charges, the cops are probably going to keep tabs on you for a year or so, to see if they can bust you.
Sooooo...My suggestion is you do not engage in any criminal activity for at least 6 months.
