interesting, my husband got his letter from homeland security and a month later a visit from the local narcotics squad, who searched our home found a bong, bowl, and about a 1/2 gram of weed, but the DA threw out the charge because the search was illegal, so I guess it depends on where you live.
i couldnt quite understand that
my husband had a package seized by customs, and did not get a letter from customs, but from homeland security. They contacted the local police, who then came to our home and searched without a warrent and threatened us with a swat team if we refused to let them search. The DA believed this to be coersion and so drop the charge of possesion. We didn't have a lawyer so they could have gotten away with it. At least our local DA is a stand up guy.

Maybe I should call up my local prosecutor and tell him that my Constitutional rights were violated and the whole thing was improperly done ? I would also like to tell him that the county will have to assume the costs of my medical care as well.

Did you get more than one letter? It's hard to tell from your story. Thanks for sharing it though. I know that was a rough experience. I wouldn't wait any longer to contact someone in your state to tell your story. LEOs can't just roust you out of bed, steal your stuff, and cart you off to jail without any paperwork.

Why did your DA not know about the search before it actually happened then? Just don't understand how they could do that and the "local" DA was in the dark? Usually they would know about somethng like a letter from Homeland Security wouldn't you think:confused:Quote:

go there and scroll down to dont get busted guides. they got some official shit there about laws and whatnot. under no circumstance can they search your house without a warrant.
Hi, no the DA was not aware of it until the day before the court hearing. In VA the police issue you a summons for small amounts. They don't haul you to jail and the officers involved didn't not bring it to the attention of the DA before they came to our home. Customs only seized a 1/2 oz and the officers involved were on a fishing expedition. They were hoping to find pounds at least that was what the officers said. We didn't find out that the charge had been dropped till he went to court and couldn't find himself on the docket and they couldn't find him in the records. I don't know if anyone can do anything now torog if you already have been to court and sentenced, but afterwards we contacted the ACLU which we are members of and they said they would have provided a pro bono lawyer,since it was a violation of our civil rights. So if it ever happens again, that is what we will do. I hope this helps you some. I'm so sorry you were treated so badly.

The way I understand it,whether or not the ACLU wins a case,their lawyers have to be paid by the State or county or city,that they're in,or in the case of federal courts,the feds pay em. I was thinking of using that as a means of discouraging my county from taking me to trial,that and the cost of my medical care . I'm pretty certain,that I will just be facing probation,but why even go through that,if the circumstances surrounding my visit,was illegal and improper to begin with ?
