Passed home test 3 days and 4th day failed?

Hey FBR -- What more info do you wish to know? I was escorted to an 'alcove' (there was on alcove for each 'pretend-nurse' I guess) and there was a bathroom off of this 'alcove' (which is really a very short hallway with flat board desk hanging from one side and a file cabinet on the other) -- The guy (I don't think these guys are really nurses) then took a cup and marked on it with a black sharpie and then made me empty my pockets into a lockbox on the outside of the door -- Then he gave me the cup and said fill it to here -- He instructed me not to close the door and not to flush -- There was only one toilet and four walls -- Nothing else -- I still partially closed the door because I felt kind of weird trying to go with the door wide open for anyone walking by to see -- So, I voided some in the blue water and then the cup and then more in the blue water -- The guy stood right outside the door and listened (I hope he was just listening and not peeking but I didn't pay attention to anything but where my stream was going) -- I took the cup out to him and he looked at the temperature strip -- Put the cup on the counter desk -- bent over and looked at it really closely from the side of the cup (it was a clear plastic and I assume he was testing the color or something) -- then picked up the cup -- Poured it into the two twin vials, sealed them and made me sign the seal -- This was a Labcorp exam performed by a Concentra center --

This is odd and unusual and I have to say I am almost certain they violated guidelines and your rights. If you gave them reason to observe, they would have watched the urine leave the body and enter the cup. Since they didn't go that far Iit stands to reason you didn't give them any reason.

Since I am almost certain this was against guidelines, if it was me, I would have closed the door and locked it if it locks. I would wait one minute before doing anything to see what happens, if they knock or try to open it if it didn't lock. If they made a scene, I would open the door and ask what the problem was with these perverts (using that term, perverts and kind of loudly). Then if they made a big deal after that comment I would state that you have given many samples in the past and you know your rights and you aren't going to let some pervert catch a sneak peck of my genitals or stare at my privates when I have done nothing wrong and you know your rights. Be prepared for them to maybe ask you to pat yourself down (they can't touch you). You may want to throw in the word lawyer, lawsuit, or sue somewhere. I would be confident that this would cause them to backdown and let you proceed. If all this fails, I would seriously consider letting them fail me. If they fail you, they are going to have to write down the reason why on the form. Watch what they write, make sure they state it like it is, they wanted you to keep the door open and you closed it. It would then go to the Medical Review Officer and he would see the faulty reason for failure and unless he is a pervert or totally incompetent he would recognize that they didn't follow proceedure and he is the final word as to whether you pass or fail.

I have subbed many times and know many others who have too. Many on these boards have too and this is the first I have heard of something like this. I have heard of a collector not following proper proceedure during a multi stall bathroom collection but not a single bathroom. You did it right obviously and this is the best advice I can give right now if this was to happen to you or anyone else in the future. I wouldn't let this stop me from subbing in the future as this is completely weird and highly unusual.

You could be nice to others that follow you at that collection site and after you pass find out who the district or regional manager is of the facility and call them and tell them you don't appreciate the perverts at that collection site violating your rights. Go on telling him how you feel so dirty and disgusted by their actions and throw in the legal speak again but say you don't have time for all that so you are calling them. Tell the district manager how you have taken many tests before because you were subject to random testing at another job and you know what is normal proceedure blah blah blah. Obviously you don't give your name and I would get them in all kinds of trouble short of getting them fired.

Very well put FBR. If collectors aern't following procedures it needs to be brought to managements attention. And that is exactly what I would do if they tried to keep the door open on me.Call them a pervert and slam the door.They have no legal authority to stare at your pecker unless you were caught cheating.

Thanks FBR -- As usual the sage of excellent Urine Cop annihilation advice -- I may send a letter 'anonymously' of-course, but if this isn't standard practice and the little goob was checking out my 'manhood' he'll probably remember who I am. I don't want to take that chance so I may just quietly thank my gods for their blessings and be on my way with it... I have one other question, however, does anyone know how quickly after being hired they do a random test on employees? Its not like the first week later is it? I work in an office and am not driving anything or messing with anything dangerous. Others in my company are driving and messing with very dangerous things however... This means I might get called again, but isn't there some kind of 'time between' testing? Do some poor folks have to test weekly because they have an unlucky employee number?

I think randoms vary widely.I've had jobs where I was never randomed and I had a job where I got a random 1 week after I took my pre employment screen.Just try and stay prepared.Subbing is the safest way.All you nedd is 10 seconds of access to a microwave and your good.
