Yeah, that seems reasonable they would charge you with trafficing. If the cops waited until you were in the middle of the deal to bust you, then someone snitched you or the other guy out and one or both of you had been under surveillance for a while. They'll probably have phone records/recordings on you guys and reports of your movements.Quote:

So, quite possibly the other guy was the snitch himself and was trying to lure someone into a big drug deal so the cops could bust...well, you instead of the other guy. This is a common tactic police use, of which I have seen happen several times.
If the above situation is true (the other guy used you to get you busted to save himself from a previous charge), then your defense may have an opportunity to pursue an entrapment defense.

Well, I talked to my lawyer today. It seems for it to be trafficking the pills would of had to be in my hand at one point, which they never were. That is part of my defense but the cop if he wishes to pursue this case farther and get a guilty plea can easily take it farther than that.
This shit is starting to get pretty complicating, the lawyer doesnt think that i will see the inside of a jail cell for this again, but im not the most faithful when he is talking about 5 year stints in a penetentieary. Basically we are going to be trying to keep this at the local level and away from the grand jury and circuit courts, at the lower level it has a greater chance of being dismissed, or possibly a better package. At the higher levels, it becomes a prosecuting attorneys actual job, and the chance of it being dismissed is virtually non existant.
If the charges arnt dismissed it is likely the Class D felony will be dropped down to a class A misdemeanor which carries a 1 year jail sentance and a 1,000 dollar fine. I really dont want to go to jail for a year with a guilty charge for whatever it is.
I need to call my recruiter tomorow and see for SURE what charges I can have and still be able to join the army, I put all my eggs into enlisting so to speak so this has really fucked me over; if I cant join then fuck mabye I can go to med school or something.

I had my court date today, I drove 5 hours to louisville to sit there for 5 minutes. We pushed the actuall date back to the 14th of may, or the '20 day date' in hopes that something may go amiss so that the charges are dismissed. Good news though, after finally seeing the citation (didn't have it at the time I first met with him), the lawyer feels much better about the case and feels that they have a weak case against me.
Things are looking a little better ^.^
