Suit Filed to Halt New Orleans Gun Seizures

The Second Amendment Foundation (SAF) and National Rifle Association (NRA) joined with individual gun owners in Louisiana Thursday morning, filing a motion in United States District Court for the Eastern District of Louisiana seeking a temporary restraining order to stop authorities in and around the City of New Orleans from seizing firearms from private citizens in the aftermath of Hurricane Katrina.
Arbitrary gun seizures, without warrant or probable cause, have been reported during the past three weeks since the Crescent City was devastated by the hurricane. In cases reported to SAF, police refused to give citizens receipts for their seized firearms. Earlier, SAF insisted that police account for all seized firearms, disclose their whereabouts, and explain how they will be returned to their rightful owners. Authorities have not responded.
Gun confiscations have been highly publicized since the New York Times quoted New Orleans Police Superintendent P. Edwin Compass III, who said, "Only law enforcement are allowed to have weapons," and ABC News quoted Deputy Police Chief Warren Riley stating, "No one will be able to be armed. We are going to take all the weapons."
For example, a San Francisco, CA camera crew from KTVU filmed one incident in which visiting California Highway Patrol officers tackled an elderly woman identified as Patricia Konie, to seize her pistol and forcibly remove her from her home. An ABC news crew accompanying an Oklahoma National Guard unit filmed another incident in which homeowners were handcuffed and disarmed, then released but without their firearms.
"We are delighted to work jointly with the NRA in an effort to bring these outrageous gun seizures to a halt," said SAF founder Alan M. Gottlieb. "Our inquiries about these confiscations were cavalierly ignored, as were our demands for a public explanation from the police and city officials about why citizens were being unlawfully disarmed, leaving them defenseless against lingering bands of looters and thugs.
"New Orleans officials left us with no recourse," Gottlieb observed. "It was bad enough that Big Easy residents were victims of the worst natural disaster in the nation's history. That they would be subsequently victimized by their own local government, taking their personal property without warrant, is unconscionable. These illegal gun seizures must be stopped, now."

it has always seemed strange to me that a government thinks it can take guns away from people who make them.
i was taught to make gun power when i was 7, still make it sometimes, it is fun in the winter, lights up the sky.

How bout when your trying to do rescue operations and your being fired on? The ones that aren't bangers will get theirs back....unless you WANT gang bangers shooting at Guardsmen?

first off, i don't believe everything the news tells me, these gang bangers as you call them, may well live where these good guys are rescuing people, so i don't believe that they would not want their homies rescued.
I remember the watts riot, i was down there then, i saw first hand what the national guard did, i was alive when kent state happened i saw what the national guard did, the last time i was in portland oregon 35 of us were pulled over, because i would not wear a helmut, the national guard came with full autos and watched as the cops took pictures of all of us, we were the gang bangers of yesterday.
Now even jay leno rides a harley (lol) makes a joke out of what was once really special.
In my whole life, i have never seen a cop help a person, have no friends they have helped, the only time i have talked to them was to find out where they were holding my friends, or to get out of jail myself.
you can believe that the cops, guard and army are there to help you, i happen to know better, they will run over your ass getting out the door or city before you, they are in it to save themselves and the ones they care for.

as if the 'bangers' will voluntarily give up their guns to begin with...he'd rather disarm my family and myself so we are helpless...

Why thank you!!! I bought her back in "97" and fell in love on the first ride. When me and the ex-wife went through our final hearing I ran into her and her new boyfriend. He was trying to give me a lil' shit so I told him " You got the bitch and I kept the bike, who do you think ended up with the better ride?" Ol' boy looked pissed....he was HOPING it would be awarded to her! NOT!!!

just because you ride some fancy new harley don't make nothin' to me, my first bike was a 1938 ul flathead that i rode on the alcan before they paved it, i worked for harley from '86 to '90 trying to help them with their image. I made the first rockin' harleys ever made, sold over a thousand of them in the first week.
harley ain't nothing to me, vaugh beals still owns the company, he also owns american machine and foundry (AMF) he is an asshole and all his upper boys are lawyers.
anyone can ride a harley these days, but they gotta wear a helmut, and my head don't fit in some goddamn lame ass helmut.
i know that a lot of folks don't practice what they preach, some of us do.
I have not driven for over 15 years, the last time i drove was just after they passed the stupid helmut laws on the west coast, after 143 tickets for no helmut, and cancellation of my insurance, i quit.
refusing to drive is my protest, and one of my gifts to my grandchildren's children, it is hard to have to get rides the 65 km. to town for groceries and doctors visits, but it is harder to accept blame for destruction of my planets atmosphere.
people just have to stop driving everywhere, or at least demand better gas milage, cars have the same gas milage that they have had for decades, how the hell is that possible?

believe me, it tore my heart apart to give up my '83 flhp, even more so to give up on a company i supported since i was 16, and more still to lose the wind in my hair, and the thrill of the open road. But I won't support lawyers and assholes that only use the people for money, and put out an inferior product because it is cost effective.

The court??s ruling is instant relief for the victims who now have an effective means of defending themselves from the robbers and rapists that seek to further exploit the remnants of their shattered lives,? said NRA Executive Vice President Wayne LaPierre.
Joining LaPierre in hailing the U.S. District Court decision was NRA chief lobbyist Chris W. Cox. ??This is an important victory. But the battle is not over. The NRA will remedy state emergency statutes in all 50 states, if needed, to ensure that this injustice does not happen again."
The controversy erupted when The New York Times reported, the New Orleans superintendent of police directed that no civilians in New Orleans will be allowed to have guns and that ??only law enforcement are allowed to have weapons.? ABC News quoted New Orleans?? deputy police chief, saying, ??No one will be able to be armed. We are going to take all the weapons.?
The NRA also pledged that it will continue its work to ensure that every single firearm arbitrarily and unlawfully seized under this directive is returned to the rightful law-abiding owner.
