can anyone please identify if this is cannabis?

i was in the yard today and saw this little plant (2 of them)
brought a bud into home and was wondering if i could possibly try and smoke it if it was cannabis
but the leaves are different arrangement than the standard
the stem is still green and the buds have a pungent smell but it is not exactly lke the marijuana smell
can anyone help me.
