How many plants can you grow before you are not considered a Home Grower?

Wondering because I have read Norml.org site, some people get hit hard for the first time, like 5 years prison or more.

I never really thought about it but how many plants would put someone past the slap on the hand "probation/fines" and actually do time?

South Florida

In Florida, sale, delivery or cultivation of greater than 25 pounds is considered trafficking, and all trafficking offenses have mandatory minimum sentences. For less than 2,000 pounds or less than 2,000 plants, there is a mandatory minimum sentence of three years and a fine of $25,000. For less than 10,000 pounds or less than 10,000 plants there is a mandatory minimum sentence of seven years and a fine of $50,000. For 10,000 pounds or 10,000 plants or greater, the mandatory minimum sentence is 15 years in prison and a fine of $200,000.

So would they weight the pots the plants are in with all that dirt or shake the dirt off the roots and then weight the plant?

In America it would depend on the state. If you have 100+ plants it is a federal offense that comes with five years in prison.

well I am far from 100

Florida law, "cultivation of greater than 25 pound" So is that just the plant, bud, both or even the dirt and bucket?

With dirt would only be a few plants

With out dirt....

My brother grows like a dozen or a little more. When/If/Hopefully when I grow I'm going to grow just 6-12 big plants. To me it's more about fun and just smoking a bit of your own bud that having a mass yield. I have a steady supplier that I would keep buying bud off, it would just be fun to smoke some nice homegrown now and then.

Hey nullific, in oregon, do you by any chance know what the punishment would be for cultivation of under 5 plants?

Possession in oregon is appearently decriminalized, the cultivation laws don't look good though.

Can anyone answer this n00b question please. How much weed would you get from growing one plant? I know it probably depends on the variables but can someone give me a generalization if possible. I'm talking about like how much would it weigh, like an Oz, Qp etc. Cheers.

Depends on strain and growing method.
Strains of Haze for instance yield a couple ounces while Chronic can give you 600g per square meter.

If you're trying to grow bagseeds chances are the plant can yield a decent amount since it was probably grown for profit and high-yield strains are better for the purpose.

Eh, Null...my guerilla farmed plant right now is making me a little sketchy. Should I go ahead and take it down or risk it? Well...what would you do in my situation?

Years in prison is the maximum sentence.

I think a judge needs a good reason to give someone
more than the minimum sentence for growing his own home grown.

If you put it in a good place and they cant connect the grow to you don't be so paranoid.

Don't tell anyone as others mentioned though.

i once designed a tree green house potter set up using some tarp chicken wire and green house cover. but like the next day some one found a huge pile of potters just like it in the US. if i ever get some plants again i hope canadian cops ignore it. actualy in this town there are only three cops left and they have to patrol this one and the town over, plus the high way in between. so no problem...

edit: i got to watch what i type, but yeah the cops are non exitant in this town

In America it would depend on the state. If you have 100+ plants it is a federal offense that comes with five years in prison.

FEDERAL LAW-- over 49 plants, which means 50 or more, 10 years mandantory, no matter if it`s a fresh cut clone or a mature plant.
each plant is a one pound weight, again, no matter what size or sex of plant.
say for example you were growing 5 females, and you took 10 clones from each, and tthen you were busted as you put the last clone in it`s container, well you would have the likely penalty of a mandatory 10 year FEDERAL prison stay, and they would estimate your plants at 1 pound a piece, which would be, 55 pounds of marijuana, which would be, cultivation with intent etc etc etc.
FEDERAL LAW overrides state law

Here are the most recent federal laws:
http://www.usdoj.gov/dea/agency/penalties.htm
Which say 10 years for a second offense, 5 years first offense.

I was under the impression that if you were growing less than 100 plants you were prosecuted under state law, more than 99 plants federal. I may be wrong, there was a thread on OG on the subject.
