Okay last month I was in an accident, however I was NOT the driver of the car. I was transfered from the county hospital (who refused to look/touch/or see me) To a trauma hopsital. In the times of me being "out of it" and sick they ended up giving me a drug test(the county hospital did). I'm still unsure of why they did if they weren't "allowed" to touch me. So, they gave me a drug test, a BLOOD test, and it came back positive, 2 weeks later. I went into the doctors office( a different doctors office, a different doctor, who didn't take the drug test) to get my pain meds(from the wreck)Refilled,and they said they couldn't give me anymore because I test positive on my drug test.....So, what I want to know is what right did they have to give me a drug test,and should I discuss this with someone(it was the other persons fault in the wreck, and I WAS JUST A PASSENGER!) Does anyone know of why they tested me, and is it a violation of my privacy rights?Just wondering......

that seems a little excessive to me. Id most definately be pissed.

Im guessing they can (if they can...hopefully not) because I think marijuana only stays in your blood for a short period of time....and im sure their reasoning would be 'If its a short period of time, and theres a presence it caused the crash'.

But im no expert.

What showed up on your drug test? just pot?

and were you knocked out? why didnt you just say you didnt want to go to the hospitol trama place?

im not 100% sure but it sounds like your rights have been violated, i dont see why they can even refuse to give you the meds because of that, i would go look into the laws of your state if i was you. just because you smoke pot doesnt mean you will abuse your pain meds.

I don't know where you live, so I don't know if that is typical in your area, but it sure sounds a little odd.

Since you weren't driving I'd totally talk to them, especially if they are going to withhold your pain medication.

yea I was knocked out, 3 broken ribs,concussion, and bleeding in my brain, so yes, I was very very unable to say no, or yes to a drug test, which If they asked me too sign anything(and i'm not sure if they did) i can fight that right?

I'm so pissed because I sit in pain because of the peices of shit....

And yes the only thing they found in my blood was..pot...

Also I didn't even know that they did a drug test, until I went in to refill my meds, and the doctor didnt give me details she just said i tested positive for pot

so when i go back 2 the doctor, i'll request my files,and take a look at them.....

if they do a blood test, are the able to tell how recent it was that i smoked, and for teh RECORD i was not STONED when we got into a wreck, in fact it had been....at least over 24 hours since we've smoked. thanks

Thats fucked up man because the same thing happened to me.. What happed was my homie didnt make a complete stop and pulled out on a highway and a car hit the side door where i was... pretty much almost died... but barely got a cut... think it was because i saw it coming and was like STOP STOP STOP!... anyway i went to our Goodsam hospital with the parents and they didnt drug test me... I mean i had to talk to cops and they knew i was fucked but id say thats gay theyd give u a fucking blood test... atleast a piss one not no fucking blood id be upset and let them know bcs u can trace blood hell of alot longer than u can piss..... little info.. p3ac3 :thumbsup:

Yes, It does suck very badly. Unfortunally there isn't a goddamn thing I could do about it besides bitch/complain,and then they'll order another drug test, in which if they do in a couple weeks, i'll be clean. IF it's a piss test. Isn't great how america works?

I know a couple people that can go in doctors office fake a back ache,and get pain pills. I get into a car accident, nearly die, and I can't? What the fuck.

I hate these hillbilly dumb ass doctors. Fuck em!

Dude, if you had broken ribs, they can't deny you pain medication. If you walked into the emergency room suffering from chronic pain every day, they would get you some pain medication. They probably checked for drugs while you were unconscious to check for drug interactions etc. I still don't know why they would waste their time checking for weed.

You should try to educate your doctor to the benefits of MJ. If you are old tell him you use it for aches and pains, if you are young tell him it relaxes you so you can study better. Don't just let THEM tell YOU that it's bad for you and you have to stop. Peace.
