Quick clarification on what is considered "parapharnelia"

    California - NORML
Possession of paraphernalia is a civil fine of $200-$300 for the first offense and goes up to $5,000-$6,000 for a fifth or subsequent violation within a five-year period.
What counts as paraphernalia? Say I'm walking down the street past curfew, a cop stops and searches me, and finds a pipe on me. Am I fucked? I'm just curious as to how pipes and bongs can be sold legally in shops all over the place, yet if I'm found with one I can be fined for it. What? Is there something I'm missing here? Do they test for resin? Or does it only count as paraphernalia when you have weed on you as well?

And I would tell you to learn the law, cops have the right to do patdowns, and if they feal something that could be a pipe during that, they can search you.

My advice...dont carry a pipe with you.

Paraphaneia is anything that can be used to use a drug. Blunts, pipes, papers, screens, glass tube, Scales, Baggies, the list goes on.

Regarding the sale of pipes at stores, they get away with it by claiming it is for tobacco use, but more and more states have began cracking down on headshop.

Dont buy pipes online, as selling instruments used to do drugs are illegal to sell across state lines, and makes it a felony if the feds ever deside to get involved. Just ask Tommy Chong!

I don't understand how a blunt is considered paraphanelia when some people actually smoke them. Same with rolling papers and wraps, cuz some people like to roll their own cigs. The only thing i see being considered paraphanelia would be a bong.

    bullshit
that would be considered a search....and cops cannot search you without probably cause.....well...actually they can if you consent to a search....
if they ask, tell them to state their probable cause and if they cannot come up with any refuse consent.....duh

What can be considered paraphanelia is a long long list but what you will get in trouble for on the street is Probably less extensive . being an adult helps! papers i cant see that happening or blunts maybe blunt wraps tho. your pipe will get u in a situation i would bet on if u have it resonated past like a few days cuz then he knows in his mind for sure it is.

Carrying pipes in a concrete jungle is dangerous anyways. Lss their tied to ur hand ull drop it someday (or ur friend) so be safe and noooo pipe or bong to be carried outside.

Running from cops is good exercise..

(smoke a blunt and walk know your safer than a baby tiger.)

oh my bad dude, usually when someone asks about something like this they were busted and then something was called paraphernalia that didnt make sense...like an apple or something....
but yeah...the list goes on and on and on and on
    pens
    pipes
    papers
    cigars
    tinfoil
    popcans
    hoolahoops
pretty much anything if your creative enough can be used for smoking

haha, i'd LOVE to see a hulahoop pipe!

edit: i thought that it was only considered pariphenalia if there's marijuana residue/resin on it. i mean, if there isn't any, can't you just claim it's for tobacco use? because they wouldn't have any proof that it was for herbage, unless it has like pot leaves on it or something, right?
