In the same way when someone dies of lung cancer from smoking 'leagl' tobacco, the state is not responsible, or when someone dies from liver disease from alcohol abuse, or when someone dies from disease associated with obesity, the state is not responsible.

How could the state be responsible? Western society has taken litigation to absurdity.
