Just got back from a long and emotional journey.

Crown Court had a huge THC4MS banner, and a small but noticable group of supporters.

We arrived in time for the hearing, and were impressed with the defence teams case and suggestion of a conditional discharge, rather than suspended sentance.

However the judge based his decsision that thc4ms supplied "a substantial ammount of cannabis over two years" and gave them a suspended sentance of 9 months over 2 years.

an order was agreed to destroy any cannabis and growing equipment, and also all paperwork thc4ms had produced and had been seized by the police, the defence argued the third point, stressing that it was probable that although thc4ms has stop the service, a campaign group would continue, and the paperwork would be needed and in itself was not illegal.

The judge accepted thc4ms had stopped service and accepted a seperate case to discuss and decided on the paperwork issue.
I understand it was accepted that thc4ms did not profit, and it was clear no fine should be imposed, although there was dispute bout court cost which totalled over 7,000.

Mark, Marcus and Lezley's second half and sentance saw a full court, with the jury box being used for public.

Lezley broke down on several occasions, her barrister told the judge she had recently started taking anti depressants and was suffering from the length of proceedings. It was also mentioned that Mark and Lez had had to close their business since proccedings begun, meaning they no longer have an income.

None of the thc4ms tthree had to stand for sentancing.

THC4MS left the court to a huge round of applause and cheers, i havent seen the news yet, but lezley was very emotional, itv was the only tv camera i recognised, there was over 20 reporters in the court and outside.

There was noticed support from UK420, including rev paul.

granny pat also made it after a break down and was driven down to the case by a lovely young man in a jag.

other lca people were Tony, Carl and Sam, and Me colin and Os, both colin and os spoke to the press, quoting the magna carta.

all in all i am pleased no-one is in prison, but feel the sentance was wrong, and the judge was a stiffler for the law regardless of the emotional and sypathetic case.

We got no room in the prisons for real criminals and yet the justice system wasted tax payers money on cases concerning an ordinary herbal plant.

If there had been any room in the local prison im sure the judge would have locked them up, yet another judge lets some child pervert walk the streets.

Im very glad to hear that no one is having to serve any custodial sentences.

It's disgusting it even went to caught, they moan that it cost 7 grand. It was 7 grand that didnt need to be spent.

i saw a bit in the times and have written a reply based on the comment made by the woman i have been petitioning since the case was bought,

the sad thing about suspended is lezley cannoy=t use cannabis for two years to ease her pain as she will be immediatly imprisoned for 9 months in her condition its appauling.

Dear Sirs,

I have known of the work of THC4MS for some time, and on hearing of their prosecution opened the following petition:

After the hearing, Claire Lindley, the Cumbria chief Crown prosecutor, said that the campaigners had not known the medical circumstances of those who received the drugs and that the enterprise had been commercial.

How can Ms Lindley make such comment when the judge made clear acceptance that the THC4MS group did not make commercial gain, and anyone present in the court was aware that every single patient of the THC4MS had sent a letter from the doctor stating their condition. For some reason the jury were denied access to the letters by the prosecution.
The whole case of conspiracy was a complete shambles, police had known of THC4MS for some years before the prosecution was made, THC4MS had been on BBC1 in an open an honest documentary of their work, as well as other national programmes and press, it is clear that THC4MS supplied those in very serious pain, who could not achieve relief from conventional therapies, and it seems that due to the law change in 2004 that THC4MS are now seen by the courts and government as a threat, down to the fact they could provide a medicine that worked for little or no cost, this must have an impact on the governments ideals of supplying MS patients with their own medicine at a high cost.
The judge demanded the jury return a guilty verdict on the case of which the jury were denied the evidence needed to gain a full picture of the case, this cannot be justice.
The magna carta of which I understood British law to be founded on states "The punishment for the crime should be no greater that the crime itself" Well who are the victims in the THC4MS case, I imagine and know the only victims are Mr and Mrs Gibson, who have lost their business down to the case, with Mrs Gibson now on Anti Depressants and with worsening symptoms of MS and Mr Davies who has had to travel a great distance on several occasions whilst himself suffering a range of illnesses causing pain. And of course the taxpayer who foots the £7,000 bill!
It is hard to imagine the pain someone suffers unless you could be them for a day, unfortunately the people who bought this case can have no knowledge of such pain and suffering MS can cause.
Ms Lindly has been aware of my petition with almost 4,000 signatures since the case was bought, she is also aware many UK citizens have now confessed to helping thc4ms on the Legalise Cannabis Alliance Forums.
The judge closed the case with comments that he hoped this case was not bought to court as a political debate, and I have to ask, when will this debate take place? The government say they do not make the laws and it is down to the police and justice system, yet in many cases it seems the judge is having to exercise the law he no longer agrees with.
I have absolutely no faith in this government, when the very beginnings of this case started with Biz Ivol of the Orkneys, who Prime Minister discussed in his question time in 2003, who died after fighting a two year case with the courts. The government have been aware of the THC4MS group since its existence and instead of embracing a simple way to help the sick, they have punished the group and their patients.
Contaminated cannabis has flooded the streets of Britain for 6 months, how many of THC4MS patients will now die because they inhale or eat glass, or fibreglass when they take to scoring off the street? Is it time medical patients could grow their own medicine? Is it time that for public health reasons recreational users should also be allowed to grow to avoid the threat of illness from a contamination the government is doing little to publicise?
I know there are people that will never agree with cannabis, but there are people that need it.
Its worth remembering Henry Fords first car was made and fuelled by hemp (cannabis) in this world of environmental crisis its about time the government woke up and saw how many ways cannabis could benefit the UK.
I promised Biz Ivol I would do everything in my power to change the cannabis laws, and now I watch another woman suffering the pain and anguish Biz did, this case is paramount to torture and the government must change the laws to either allow their medicine Sativex to all MS patients immediately on the NHS, or allow those with doctors confirmation the right to self medicate, if they do not, it seems this government are becoming terrorists themselves, as so many ill people are terrified of using the only medicine that works for them.
