I would have told my lawyer to tell the judge that my eyes were red because of my contacts and the THC in my system was from a party a few weeks before the incident. Then the prosecution would be stuck trying to prove that I was driving while high. They would have no way to do this. Since I am innocent until proven guilty, i am innocent of all charges becuase how are they really going to prove I was stoned.
I dont know why that didnt work for you. Maybe your lawyer was an idiot or maybe you just didnt say the right things.

it doesnt work like that man. its a loophole, you me them everyone knows that if you have thc in your system it could have been from three weeks ago, they don't care, the law is that if its in your system and the officer who pulls you over thinks you're stoned and you fail the test, y..o..u....a..r..e...guilty.

Well at the moment i dont drive if i have had a spliff that day because i dont know the laws and i am a new driver. I live in the uk anyway i noticed quite a lot of replies where from america. i knew it would be vague* (sp) i just wanted to know for my own legal safety.

Did you try to discredit the officer? Just because he is a police officer doesn't mean he can tell if a person is stoned. What did he have to go on? Red eyes? thats bull shit.

You can't get THC in your system from contact high. You can inhale as much 2nd hand smoke as you want from herb and still pass a drug test.

Driving whilst stoned is stupid and irresponsible.
You are driving a ton of metal while your senses are impaired, what you going to tell yourself if you're involved in a fatal accident?
Most stoners get nicked while driving because of a stupid fuck up like forgetting to switch on thier lights or not indicating for a turn.
