Just busted for paraphernalia

How did you get searched. Do you know your rights? Did he have any reason to believe you might have been smoking weed that night? I can't believe how they treat us for marijuana. This is bull shit. Sorry about that man, I know everything will go alright but every time I see some one gets busted for weed and drug classes come with the sentence...I really wonder how the hell do they send you to drug classes for weed?

check this story out!!! just got told by mom to move out cuz she found my bag and bowl. so i went pick up a buddy got the daily fish wrap went to some park to read the ads for apts. we smoked a bowl on the way to store & on way to prk. sitting there reading the paper and who shows up but jonny law man. so i make sure pipe and bag is hiddin it is but in my pocket??? so he askes for ids. runs them comes back to us as hes giving my buddys id back to him 2 more cop cars show up!!! i thinking this cant be good!!! he comes up to me and says theres a warrant for my arrest. lol so i asked for what. a unpaid fine. so i get cuffed he finds my weed and pipe takes me down town to booking and stops outside the jail puts my weed and pipe in this paper lunch bag and gets out and puts it in this garbage can that is on the side of the streets. he gets in his car and says well iam not going to do anything about that stuff cuz he fiqures i got enough problems. i get booked i make one phone call to my buddy tell him to get me 120.00 bucks to bail me out. he does less than an hour later. i am walking to his car laughing cuz iam out in less than an hour. i went up to the trash can and pulled that paper bag out and jumped in my buddys car and left laughing my ass off ... then we got pretty stoned after that..

Instead of lying to the officers you should simply have not incriminated yourself. It's simple. Plead the 5th if you have to. It sucks you got arrested, you shouldn't get punished that severely.

No I don't think it's illegal to have papers in the US. I always have dutches or papers on me and I don't sweat it. I can also just eat weed in like 2 seconds.

So, he just came up to you and searched you? I'm no expert but I'm pretty sure they can't just search you for no reason. Did you leave something out of the story? Like, whatever it was that gave the cop probable cause for a search?

Yeah, they can search you for no reason. It is called a pat down for weapons. Then you get into the plain feel rule which was established by a Supreme Court case, I think US v Carroll. If during the pat down for weapons an officer can tell there is something on your person by plain feel that may be illegal, then he can basically keep searching. Cops will use this "I searched him for my safety" or "for weapons" as a blanket excuse to search you.

Being your first time, there will probably be a way of getting some sort of pre trial intervention or deferred adjudication or judical diversion, depending on the state. You keep your nose clean, pay some fines and court costs, maybe do some drug classes and testing, and when you complete it, your record gets wiped clean.
