friend got expelled

So one of my friends got expelled from school this past weekend, after the school found a couple cases of beer and a scale with thc on it in his car...I just found this out pretty recently and was confused because the school didn't have a drug search last week at all (about once a year they run dogs through the school and parking lot and shit). What i heard today was apparantly he parked on the middle school side (our high school and middle school are connected) and the liason (sp?) officer thought it was suspicious so they searched it...I thought that was total BULLSHIT...so a kid parks on the middle school side (and our school is small so it wasn't like he was far away from the high school part) and automatically it gives police probable cause to search their vehicle...I was appaulled...Somethin like this woulda never happened in a bigger school, granted he never should have had that stuff in his car but still...I spose the school is gonna do what they want to do no matter what...It's not even like this kid's a bad kid...only thing he did was love to have a good time...FUCK THE ADMINISTRATION.

yeah that is pretty sketchy man. only probable cause is something in plain view really (if the owner of the car is not present to give other reasons for probable cause)

Well, TSchmidty, your friend may not be a bad kid, but he's clearly not one who thinks much about the ramifications of his actions. Schools, in case you haven't figured it out, are not like the rest of the world when it comes to privacy and Bill of Rights protections. The courts have pretty much routinely sided on the behalf of schools when it comes to searches, seizures, probable cause, and the like. Fair? No. But schools make their policies very clear from the get-go about not bringing any remotely drug- or alcohol-related materials onto school grounds.

Sounds like you might need to place the blame here where it really lies, on your friend and not the administrators of his school.

yeah yeah i understand all that stuff and i knew he shouldn't have brought that shit...it just gets frustrating...What a day it will be when weed is decrimilaized.

not to mention that just the act of possessing alcohol as a minor is illegal, and a scale on top of that.. Yeah he should have been smarter then that, not sure how kosher the search of his car was but l it was on school property and laws involving school property tend to be pretty strict and lean towards the side of the school a large percentage of the time

god damnit whats up with these schools? they can search your car w used to ride mods to school liek he speedifght 2 or gilera runner and theres no chance they would get to look under the seats let alone in our cars if we could drive that young.......damn
