they are not required to hire her back if she quit, if she took a maternity leave, thats a different matter and nochowder would be REQUIRED BY LAW to be informed that his job was temporary, it sounds like he wasnt informed. if she quit her job then she cant just be hired back. btw it sounds like your not going to take any legal sort of retaliation against them, which might be for the best, it could take time away from precious job searching and all. you should get a little revenge tho, just leave an unsigned not by the workplace for her to find, letting her know how she screwed you over and how you will hate her for the rest of your life, etc etc etc, the usual stuff

If a person had the job, and left under the FAMILY MEDICAL LEAVE ACT.....stating the she is allowed to take time off to have her baby, and come back.

to care for an immediate family member (spouse, child, or parent) with a serious health condition; or
to take medical leave when the employee is unable to work because of a serious health condition.

actually yes, read my posts you will see i said many times she might have the right to take her job back under having a leave of absense due to pregnancy, but that's not the way nochowder makes this all sounds, to me it sounds like she quit, just plain out quit, which means she gave up the job, and has no right to come back and take the job back, regaurdless of the circumstances of her life.

as i said, if she took the leave, she has every right to come back and if the employer didn't warn of this first then, he is responsible. no where does chowder mention the boss mentioning the job is only temp. until the original worker comes back.

We all know bong can be one opininated dude, but believe me, this man has a lot of compassion in his soul. You have to see between the lines. It sucks nochow, you lost your job, but you are at-will employee with every job you go for. Face the fact. Besides, it bodes new opportunity, perhaps find something better than working in a kitchen?

I can understand where where Bong30 is coming from, but next time, refrain from calling me, "not man enough." That's a personal insult that has no direction as none of use truely know one another.

I'm no longer mad about it. I'm a little choked, maybe even a tad depressed over it all, but it's done and over with. I just don't like it when someone else favours someone else who is just trying to do what I am, make an honest buck working. I know she has a baby now to support, but I feel that they think her life and what she has is more important than my own.

How goes it, with the Job hunting? I hope you have found a better job then the one you lost.

The last time I lost a Job i thought i was going to barf........It hit me in the gut hard. I looked up and saw my wife and kids, and made it happen.

I decided to go to work with My Step Father, and 3 days into training he fell and broke his hip. 11 days in the hospital, out for 2 months.

His Family, my familys livelyhoods were in jepordy...........tough summer

I had no Idea what I was doing, but I woorked my ass off and saved Bolth our familys...... NOw we are doing so much business we have to get a second rig.....

Hang in there.......... You want some good Karma? Go ask the (fat Prego Bitch) If she Is doing OK with the new baby, and wish her the best. Hold your head High and walk out knowing you are the better MAN.
