we were smoking nd they jus ran up outta no where it was so weird cause we were talking about how white lighters were bad luck nd u get caught nd my friend peeled the decal off a bic lighter nd it was white than he threw it nd litterally 10 seconds later there were cops

I f you werent read your rights, then you can easily get your case thrown out...but thats only if you got arrested...But like Tomorrow said, sounds like they have no case so get in their face (not literaly, and be as polite as possible) and tell them they need to charge you or leave you alone, if they case is that shitty theyll usually not waste their time
And for future refernce, visit the NORML website, they break down they various laws for every state, which is VERY helpfull....

yea i actually did check norml but since none of my charges are related to possesion it hasnt really helped me out

Oh..well if you get charged with elsusion only, thats a completely different case. I know theres some law about how if someone is eluding an officer that the po-po can wait till your detained (like in handcuffs in the backseat, or where the officer knows you cant easily run again) to read you your rights, but outright not reading them to you pretty much means a dismissal.

If you don't have anything on you, you shouldn't run. Even if you do have something on you, you shouldn't run. They'll follow. Curfew charge is nowhere near as bad as evading arrest, but I'm sure you realize that now. Whatever happens, good luck.

Well if they did not say you under arrest since you had nothing on you, how can they charge you with evading arrest? Sounds like the cop is a little Dieee Dideeeee to me And also the cop did not read you your rights when he illegaly dedatined you. I would own that cop in court if I were you:thumbsup:

He ran. Cops are allowed a lot of freedom when you run.

It depends they don't have to read you your right's depends on what kind of case it is. I had them make me sign that my right's where read one time. but your best bet is not to say a word

Ya, if they arrested you without reading you your Miranda rights you may have a case to get out of. I'm not 100% sure you'll prolly need some sort of legal representation.

I've run from the cops before and gotten caught but they've never charged me with eluding arrest.

wrong wrong wrong. you eluded a police officer before he had a chance to read you your rights. he couldn't recite them to you while he was chasing you down. you almost never get charged if he found nothing on you and someone else claimed ownership of anything they found (assuming they did) plus your 17 and a charge is even more unlikely.

I don't get it. Couldn't he recite them to you after he catches you? When he's arresting you?

Isn't that the whole point? To have your rights read to you AS YOUR BEING ARRESTED?

Again, I'm not a legal expert, just wondering here myself.
