Just Got Busted

Last night after smoking a lot and drinking a lot we went out to go get some money from the atm now the whole car was full and i forgot i had weed and my bowl on me so we see a cop has pulled someone over so the three black kids in the back decide to yell out fuck the police doing so another cop pulls out and pulls us over they save me for last i thought i wasnt high but 3 blunts and a lot of bowls said otherwise so i stash the stuff under the seat cause i was freaking out but i wasnt driving the cop comes over and knows the black kids like there friends he has busted them before so all of us get a breathalizer i had like 8 beers and passed somehow the cop took one look at me and goes you been smoking and i was like yes and he goes you look stoned out of your mind.

So he tears through the whole car looking everywhere he finds the weed i gave the kid to hold he waits for my spot last and then gets the pipe and the roaches i was like shit and i got disorderly conduct it sucks cause some people dont know how to be chill and dont call me a racist but the fact that these black kids have been caught a lot also made things worse. But we were all fucked up thats my story

No, you weren't busted, you ratted yourself out. Theres a difference. Do you realize you have the right to remain silent? You DONT have to answer any questions without a lawyer. You also do not have to consent to searches. Only way to get busted is if you have something in plain view. Why bother hiding your stash if your just gonna basically say "yes i have been doing illegal drugs"

Nope, a cops "hunch" is never probable cause. Neither is him claiming to smell something funny. Only probable cause is if something is in plain view, like roaches in an ash tray, a mysterious bag with green stuff on the back seat, etc. Then, he can check out whatever he sees, and if that roach in the ashtray is weed, he can proceed to search the car.

Its really not hard to avoid getting busted...people just don't know their rights or are too scared to excercise them. Cops intimidate people to think otherwise, seriously, everyone watch that video, as long as you hide your stash, you are pretty much safe.

You don't have to talk after you are arrested, before then you have to answer any questions. I also agree that you shouldn't have just told him you were high.

I know i shouldnt have told him but he knew i was stoned and why lie and risk more shit i personally dont know why the driver gave him consent to look in the car but cops no that a car full of guys at 3 in the morning and one guy under 21 drunk and almost every kids eyes red in the car we were fucked and i was nervous as shit cause it was such bullshit for those guys to even say that shit

I am not going to court i got disorderly conduct i guess i got off pretty easy i will get a fine in the mail but i know what people will say it could have been worse and i know it could have been i could have spent the night in jail or probation

You didnt have to LIE. Trust me, you can just say nothing, if he bugs you about it, say you have the right to remain silent, theres nothing he can do about it.

It doesn't matter if its before, or after you are arrested, you don't have to speak without a lawyer. Like I said, watch that video and learn the law.
