Burn rides are very common for me and my friend since we live in dorms on campus. I was just curious, if a cop pulls us over and they smell weed, what rights do I have as an individual when it comes to searches and whatnot. if we don't give permission can they still search the car or search the bag that is closed up with all of the weed and bowls?

I usually keep pariphanalia and weed in its own bag zipped and buttoned up. Any other precautions I should take

Am curious, because deep into the entrance at school they had a road block one night and were talking to every car that passed. Had an oz. of weed (buy in bulk) on us and it was a little scary.

First piece of advice: I am not a lawyer. You want legal advice, get one.

But that doesn't mean I don't know a few things.

There are three reasons why a cop can conduct a search:

1) The cop has a warrant to do so. The warrant must name the premises to be searched, and what they expect to find.

2) The cop has probable cause that a crime is being committed, or that you have committed a crime. "Probable cause" is a legal term meaning, it's good enough for a court to say he had a good reason to think there's something going on.

3) The cop has a legitimate reason to be concerned for his safety.

The cops you describe don't have warrants. But smelling weed, my friend, is indeed probable cause. It's enough so that cops learn to know what weed smells like at the academy. (Later, when they're on the job, they refresh their knowledge by burning evidence and taking it into their own lungs so that they do not pollute the air. Then they hit the donut shop.)

It's unlikely that you will do anything that will threaten the cop. But be aware, cops have considerable leeway to search your vehicle once they've stopped you for something else.

Unless I'm bringing it home or going on vacay, I do not carry. There's no way a cop is going to smell weed coming out of my windows, and there's nothing about my home that's threatening to anyone. Thus, the only way they can search me is with a warrant, and there's no reason why they'd ever need to get one.

It seems t'me that the police in your area are having one of their occasional crackdowns. The evidence pool back at the station house must be getting smoked down, y'see, so they have to go round up a few usual suspects and seize their felonious and unlawful packets of sativa.

Were I in your shoes, my feet would hurt (because I'm a size 11 1/2). And I wouldn't be holding in public.

in yer car iz one ov the least safest placez 2 carry weight. az fer yer rightz, byker pretty much nailed er. ov course the lawz r different in ery country, but fer the most part thatz how it iz.

I live in a dorm on college too. Just bring alot of cigs with if you see a cop coming just roll the windows down and start a puffing the baccy like mad.
Just gotta be smart I mean if a cop sees a parked car with smoke rolling and nobody taking a cig to their mouth they are going to wonder what is going on. Always be aware of your surroundings.

The best thing to do is just not leave lots of stuff in your car. If you are carrying extra on you put it in your trunk. Even if they search your car they cannot search your trunk without a warrant since it is locked. That also goes for other parts in the car as well I believe, so if you have an area in the car you can put it in and lock it in there, they cant do shit about it without a warrant. The best thing is just roll a joint and smoke it cause if you get pulled over you can get rid of that pretty easy and then they cant do shit. The biggest thing is be smart about things, I had to learn the hard way twice, but after talking to my lawyer and using more common sense I have had no probs since.

id have 2 agree, common sense iz sumthin u need if yer gunna b smokin in public in a no tolerance area. but once the copz have probable cause on yah, common sense aint gunna make a difference. rnf i not sure if the lawz r different here but it dunt make a differnce if itz in yer trunk, if u get pulled over fer sumthin illegal, even if itz juss speedin, the copz can search not only yer car, but yer trunk an anythin else u mite have thatz locked up in it. u gotta realize that yer rightz change drasticly once u go frum innocent 2 havin probable cause on u.

Well in the uk i duno if its different or not but heres a story.

One night me and 1 cousin and a friend parked up a smoking spot we were stoned as fuck already from drivin and smoking but we faniced a smoke there so we pulled up i went for a piss and whilst i went for a piss my friend prepared an L for me to roll luckly i got back in the car and started moanin sayin it was shity prepared and the cops rolled in my cousin hid the skunk in a dodgy place a pannel jus comes off and stashes his stuff down there. the cop car was looking right at us with full beam we were like wtf, there was only one copper there, he searched me properly and he didnt search all the others properly he also searched the car and found nothing what a dick was pretty funny after, he didnt give us his name he jus said where he was from he found out ash tray and there were only a few spliff ends, he got our addreses fucked off and we blazed up there lol

How about purses and backpacks. Are the police allowed to search those items?? Or is it only things that are locked that they need a search warrant.
