Just to clarify my earlier statement...In Texas, you can defend yourself with deadly force. So, replaying the exact same scenario you just posed, the driver could have shot you. When the police came out, you would have been arrested after they took you to the hospital. Why? Because you assualted someone first.

Recent happening: Lady is at McDonalds with her daughter. Too much traffic so everyone is having a hard time moving around. Some guy gets mad b/c she's in his way. She explains she can't move, a verbal altercation ensues. He goes and gets a bat and comes after the woman. He never struck the woman; but she was able to get the bat away and bash him with it several times. What did he get...a few broken bones, a feloney arrest, and an embarassing 15 minutes of fame...b/c he couldn't get his McGriddle in time...
