Bush seeks to extend Guantánamo procedures to American citizens
In draft legislation prepared in response to last monthâ??s Supreme Court decision against the use of military tribunals for US prisoners at Guantánamo Bay, the Bush administration proposes to extend the practice of indefinite detention and summary trial by military commissions to include American citizens.
According to press accounts Friday, based on leaks from those with access to the draft, the bill would essentially legalize the military tribunals in the form decreed by Bush in 2001, with only minor changes, while for the first time making US citizens as well as foreign nationals subject to such summary proceedings.
The tribunals, commissions of active-duty military personnel under orders of the president as commander-in-chief, would have the power to impose death sentences based on secret evidence and in proceedings from which the defendants could be excluded whenever military judges decided this was â??necessary to protect national security.â?
The Washington Post reported that the draft legislation had initially reaffirmed the 2001 Bush order that limited the jurisdiction of the military commissions to â??alien enemy combatants.â? This language was crossed out, the newspaper said, and replaced by language giving the commissions authority to try anyone â??engaged in hostilities against the United States or its coalition partners,â? regardless of nationality.

In my opinion To protect our civil liberties is of utmost importance to keep a Democracy alive in the U.S. The secret wiretapping is unacceptable and can not continue and warrants impeachment of the perpetrators of this illegal action against the American public. It is apparent that this administration has no regard for the privacy of the American people or respect for the Constitution!
Bush and Cheney on 911 interviewed behind closed doors, refused to take an oath, refused to allow tape recordings and ensured no transcript be kept but they tell us (citizens) they can spy on who ever they choose. Tell Congress to do their job as they pledged to the American people and God to do! Impeach and Indict this administration for TREASON! Remember any PEOPLE are responsible for the regime they are willing to put up with!

Interestingly, Castro is against all terrorism, and Guantánamo is (physically) in Cuba. Why don't we ask the author of the above, Patrick Martin, about the "rights" of people in Socialist and Communist countries?

The legislation has one major hurdle to over come, Posse Commitatus. SCOTUS would never overturn Posse Comitatus because it very strong standings in the Constitution. These are Article III Section 3 treason laws. Congress could repeal Posse Commitatus. But that would essentially legalize treason. Congress won't legalize something a harmless as marijuana. I don't think they would be able to get away with legalizing something as harmful as treason. But these days you never know.
