Unfortunately, since it's legal by state law and not federal law employer's have the right to still drug test you, and fire you, for marijuana. From what I've read, in California, it's entirely at the employer's discretion.

I recently joined a new company which has a policy allowing them to request drug tests. The job is great: good money and good work. So I'm going to accept the position. I'm not sure if the drug tests are random or only done with cause (i.e. you show up to work looking stoned). The way the policy is written, it doesn't say anything about them having randomized drug tests -- just that they can perform them at their discretion. Rating: 5
