I suggest that the judge read Ain't Nobody's Business If You Do: The Absurdity Of Consensual Crimes In Our Free Country by Peter McWilliams (http://www.mcwilliams.com/books/aint/toc.htm). It pretty much demolishes every argument for punishing activities which harm no one except maybe the people doing them.
