    Minor Consumption of Alcohol

Okay, I saw a grunk in public post somewhere on these forums and figured it'd be good to ask you guys this question. Okay, I was at a friends house and there was drinking going on, well, someone had accidently poured alcohol on my coat and I decided to walk home. It was 1:30 AM and a cop pulled me over not realizing I was 18 and smelled alcohol on me, he never gave me a sobriety test nor did he have me blow in his face but he wrote me up for an MIC. btw, I never even said to him I had drank it, he just smelled it on my coat. What should I do?

btw, my opinion on underage drinking is that if I'm old enough to die for our country and to get the death sentance than I'm old enough to have some to drink. :P Not that-that realy matters, I'm sure many of you think the same thing.

    Hey kc3,
WTF is a grunk and a MIC? Anyway, you were right in not cruising with booze in the belly/brain. I'm sure if you have the opportunity to challenge the (MIC?) in court, you'll enjoy the show when the judge hears the evidence(?) of why you`re taking up part of his/her day. For what it's worth, my opinion on underage drinking was the same as yours when I was there. As luck would have it, the state of Va. lowered the drinking age to 18 when I was 17 and the Vietnam war ended. Little D

MIC is minnor in comsumption, they will most likely just make u take this stupid class and all u do is pay like 100 dollars and sit in a class for one night for like 3 or 4 hours, and listen to this dude talk about they dangers of drug and alcohal abuse, the guy that i had to serve my time with in that class only talked about weed for like 5 minutes and then he talked about the other dandours drugs such as meth and crack.

i mean if u realy want to spend the entire day in court fighting some thing go ahead, atualy it might be better to just do that in your case, but in my case, i blew well over the legale driving limit, .08 and they gave me like a get out of jail free card.

Alcohol has no odor. It could have been non-alcoholic beer for all they know ...

Odor alone, while likely enough to investigate, isn't enough to convict without a positive breath / blood test and/or witnesses, etc.

Unfortunately, most people, especially teens, don't know their rights and furthermore their parents are ignorant too of the law / one's rights; often can't afford the representation that can make all the difference ... money == justice ... sad, but most often true.
