well its possible they could have lied. i cant see any circumstance where the guys who owned the house/weed would have ever let the cops in there.

Lied about what? It doesn't matter. Let me show you how easy it is.

    LEO: "Knock knock"
    (open door)

YOU: "Hello officer, is there a problem?"

LEO: "We received a call reporting robbery at this address."

YOU: "Gee, everything is fine here. I certainly didn't make a call but I do appreciate you taking your time to make sure everything is ok."

LEO: "Do you mind if we come in for a second?"

YOU: "Honestly officer I'd rather not since everything is ok. I just want to go back to bed and I apologize for you having to make the trip but again, I do appreciate the quick response had something been wrong."

LEO: "Why can't we come in. Are you hiding something?"

YOU: "Absolutley not. But I do enjoy exercising my constituitional rights. Is there anything else you need before I retire back to bed officer?"

LEO: "Sorry for the mistake. Have a good night."

    YOU: "You too officer"
    (close door)

See, it's that simple. The police CAN NOT...repeat CAN NOT enter your home without a warrant and/or YOUR PERMISSION.

If they do, it's an ILLEGAL SEARCH and the case would be thrown out of court in a heartbeat. Any DECENT lawyer could make that happen.

Now, there are some cases where they may enter your home without your permission. One example might be a domestic violence call where the parties involved are still in the home and fighting. In order to solve such a call its obvious that officers must beable to enter the home and subdue the problem.

Eitherway, they can't just make up a problem, come to your home, and enter to search your property.

And honesly, if the police had proof this guy had that much cannabis in his home before hand do you think it would have been that hard to get a judge to sign a warrant? NO

They certainly wouldn't risk blowing the whole case by doing it illegally when they can just as easily setup a sting and make their department look good by making a huge bust.

We are talking about some serious weight here people.... If they truely knew what this guy had before hand, they would have busted down his doors and thrown a warrrant at his face.

Sounds to me like a stupid "criminal" story.

What probally happened was someone panicked and called the police.
They came and asked if they could come in.

Now here's where %99.9 of people make the mistake. They get nervous and allow LEO to search their home/car. I think people tend to think if they say no it will make them look guilty so they just grab their ballz, say yes, and pray LEO won't find what they've hidden.

And TADA! Before you know it they found Lots "o" pot when all you had to do in the first place was prove to LEO you KNOW YOUR RIGHTS and will STICK BY THEM.

im not listening to anyone who says these guys asked the cops to come into their house unless io comes from their mouth. i am well aware you have to give permission. im also well aware the if you had 2500 pound in your house you could probably smell it the second the door was opened, which would give the cops probable cause to search the house.

The Patriot Act doesn't give the police the right to enter your home whenever they feel like it.

I've had these same debates on overgrow (RIP).

Fact is, if you show an officer that you're intelligent and know your rights things will go smoother. If you show them you are nervous they will assume you are guilty of something and use that nervousness against you.

The majority of people who get busted are people who gave CONSENT for a search. This is a FACT people!

You can argue all you want, pretend like we have no control and the police can do whatever they want. The simple fact is you are WRONG and spreading such ideas only harms the people's opinions of what they can and can't control.

If LEO busts you without providing a warrant, consent of search, or reasonable doubt (via smell or visually seeing illegal items/activies). Then get yourself a GOOD lawyer and things will start looking up.

If you got busted before and believe I'm full of crap.... chances are you probally:

    A) Consented to a search
    B) Received a warrant
    C) Had illegal items laying around in plain view
    D) Had no odor control
    E) Physically/Verbally assaulted the officer and pizzed them off.

Does that mean all busts are legal? NO. But it does mean if you KNOW your rights you can fight back. If not preventing them from illegaling finding something, then to expose the illegal search during court.

During college one of my professors was Ex-DEA and we use to talk about this sorta thing ALL..THE..TIME. She hated watching fellow LEO members step over people's rights but she ALSO knew that those who it happened to generally ALLOWED it to happen.

Moral of the Story: Don't give LEO anything they could use to step over your rights. Speak with intelligence, be nice, don't "act" like a stoner, and stick to your "legal" guns.

If they threaten to search anyways, tell them they're making your lawyers job must easier. lol

If you don't BELIEVE in your rights, you don't have ANY. PERIOD!

suhl, that's the whole point of this thread is it not?

Why would you call the police to your house knowing full well you have tons of stinky sticks in your home?

    A) Panick
    B) Stupidity

But to say that LEO made the whole things up just to walk in their home to search for pot is highly unlikely. That would assume they knew what they had before hand. And if they had that information they can easily get a warrant.

Thus, making this "The police made a false report just to bust this guy" arguement pretty pointless.
