Man caught with pot criticizes judge's sentence

NEW BLOOMFIELD - A man who will go to jail because marijuana was found in his pocket told a Perry County judge his sentence is too harsh compared with a man who assaulted a young girl.

"I don't hurt anybody to pursue my happiness," Steven D. Hess, 39, of the 300 block of Mountain View Road, Shermans Dale, told Judge Kathy A. Morrow on Thursday.

Morrow sentenced him to 48 hours to 30 days in county prison and fined him $200. Morrow also gave Hess credit for the one day he has already served in jail.

Earlier in the day, Morrow had sentenced Jack M. McGowan, 59, of the 300 block of Pisgah State Road, Shermans Dale, to 12 months' probation and a $250 fine for indecent assault.

"And you let him go," Hess said.

McGowan had pleaded no contest to a charge that he inappropriately touched and kissed a 10-year-old girl on May 13 when he gave her a ride to the Carroll Twp. park.

"What you did was inexcusable. You took advantage of a 10-year-old girl," Morrow said to McGowan.

"If you ask me, they should have their eyes poked out, ears poked out, castrated," Hess said.

To which Morrow responded, "There's only so much I can do."

Hess was arrested in August 2004 when an ambulance was dispatched to his home. Hess was found unconscious on the front porch. An EMT on the scene had cut Hess' jeans off to treat him. The EMT found a bag of marijuana in the pocket.

Hess pleaded guilty to possession of a small amount of marijuana on Jan. 19.
