Cell phones and wireless home phones don't need a tap. They transmit in open air waves and the cops just have to sit down the block with a reciever. All legal! There was a case in Iowa where the dude took it to the Supreme Court and it was ruled as such. They were probably looking for either something stashed or more than likely the serial number of the phone to get past records.

Best course of action? He should keep his mouth shut and take the penalty like a man! The only thing a "deal" will buy your buddy is a bad name!
