penalties in different states?
i was looking around at the diff laws states have and some its a misdermenor and they just fine you if u have like less than an oz on you and so on and as long as you show up in court you arent incarcerated just fined...i was wondering if that was every time you got caught or just the first, and in states like cali with the 3 strike rule does that apply?

Yeah but the laws should state if that's the case, and it usually is the case. If you are a first offender without a record they might not convict you of anything, but being a second offender or having a criminal record definitely makes things a lot worse for you.

It seems to me that it falls on how the judge feels. Its fucked up but, I've sat in many court rooms and noticed that the judge does what he wants, even in mandatory sentence cases. Cali does not have the three strike rule any more, it was struck down by the high courts. They use three like priors to enhance a sentence.

Stay away from Alabama! Read up on their "Enhancement Law"....And you better make darn sure that NO schools,daycare etc...are within so many feet of "dealing"...Could be your FIRST time ever in trouble and you could get 5 years alone on that one charge. Certain convictions here such as Distribution you WILL pull at the least 3 straight years....no parole,good time,work release etc....no community service. I read last year where some MJ offenses that were previously felonies are now misd....but AL is one State that plays hard...very,very hard. Stay away!
