Serious Question For Car Accident Victims

Alright as most of you know I was in a car accident with my entire family in the vehicle. We were hit by another driver and his insurance company denied our claim. I hired a lawyer and they found out he has a policy limit of $300,000. Currently my lawyer is waiting for my final doctor's visit which is on January the 6th so then he can then file a demand claim against them.
Just say they wanted to settle instead of taking it to court. How long would that process take until I receive my settlement?

I also spoke to the governor of my state and he is investigating the issue as well. Trying to scare them you know.

I personally was not in an accident. But have known 2 in Arizona who were and one here in Washington State. None of these were their fault. Insurance carriers agreed to settle out of court.

The guy here in Washington state was in an accident 3 years ago. He submitted his final doctor reports a 1 1/2 years ago and was just given a check last month for $50,000 after the attorney took the customary 1/3.

Medical bills were covered seperately. Needless to say in just 30 days hes broke. Instead of buying 2 high end new vehicles he should have gotten 1 good used replacement vehicle and invested the rest in real estate. Now he has high insurance premiums on 2 sport vehicles. Both of these assests will depreciate quickly. But thats just me.

I dont know why it takes soo long to settle out. The negotiation back and forth just seems to take forever between all the parties involved, your attorney wants to get out as much as he can and the other side has an attorney that wants to fight to keep as much as they can. Thats why they begin by saying, "claim denied". Thats customary.

Same situation for the people in Arizona. Except one was settled in 6 months, but the damage on that one was minimal to vehicle only so I think that is the reason.

So I think the higher the amount of physical injury, the number of victims and loss of vehicle in terms of dollar amount the longer it may take to negotiate.

Nothing seems to be set in stone in a time frame. I just know it can take a while so be patient. Stay on top of the attorney every 4 weeks or so to make sure he is making progess and keeping you informed of what has happened to date. I wouldnt wait for him to call. Keep good records of everything of course.

Dude, you could be looking at forever, if you want.

I finally settled after 2 1/2 years, but not nearly for what I wanted. I easily could have pushed it another year, or so, before making the decision to even go to court. Then, once that happens, it could take a long time.

But, I pushed it several months by not accepting medication for my injury. I knew it would change the chemistry of my brain. When I did take the medicine, I lost a lot of weight and then after I stopped taking the medicine, went to a restaurant on Rudee Inlet and ate a house. Or, in this case, a houseboat.

Sadly most insurance companies will deny the first few claims.
Saves them money and they dont care about you or anyone else.
Insurance companies can drag shit out endlessly it seems.
For your sake I hope you have a good attorney that will push for you and wont break it off in you after the fact.

When I was hit in my jag,it took less than two weeks for my check after the insurance companies reached an agreement.You may wish to take it to court instead unless your state has a cap on how much you may receive..My cousin is a lawyer..
