New Jersey Jury Finds
NJ Weedman

Ed Forchion, aka the NJWeedman, has pulled it off. Forchion was busted in New Jersey on April 1, 2009 for possessing a pound of pot and $2,000 in cash. He faced a mandatory minimum of three years in jail and a $25,000 fine if found guilty. On our radio show Marijuana Compassion and Common Sense a few before he left for New Jersey for the trial, Forchion made it clear he would be using a defense based on jury nullification.
Jury nullification is a risky defense with jurors usually following a judgeâ??s instructions that they cannot do that, but it worked this time and it is sure to have an impact on other cases as well. At the trial Burlington County Superior Court Judge Charles Delehey was really pissed when Forchion told the jury they were allowed to disregard New Jersey laws against possession of marijuana.

In Forchionâ??s case however, the jury ignored the judge and the prosecution, returning a verdict of not guilty after about 90 minutes of deliberation. Jury nullification has been touted for years by marijuana law reformers, but this is one of a handful of cases that it has been successfully used.

Unfortunately his victory was short lived as less than two hours after the not-guilty verdict was announced he got a call from the DEA in Los Angeles. Forchion has a collective in Los Angeles named the United States Collective and the following day a DEA agent dropped by the collective advising his employees to close by the end of the business day.

Apparently the staff got nervous and did not open the next day so Forchion is returning home to staff the collective himself. I hope to have him on our radio show again in the not too distant future. His story is one that we all need to hear.
