State laws and info in regards!?!?
So I was curious to if you are able to grow to sell to dispensaries and if so what actions must be taken to do so or if you can only grow for personal use. I understand that you can apply to be a non profit but everything I have seen has said that they aren't currently accepting those applications... If any one could help me out that would be great, I'd really like to be able to be a supplier for a dispensary but I don't know if it's possible here in new Mexico and if so idk how to go about doing such a thing

Nope. Patients selling to producers or to other patients is Not allowed currently. NM has licensed producers which are also the "dispensaries". The producers are charged with doing it all.....from seed/clone to patient. There is some testing, but not all the producers test. Patients can obtain personal production licenses which entitles them to grow 4 mature (flowering) plants and 12 seedlings (non flowering). They are allowed to possess 6 ounces at any one time. Each patient can buy from a producer up to 6 ounces. Any patient who purchases more than 2 ounces in one transaction must be reported to DOH (on a quarterly basis). If a patient produces more than the allowable 6 ounces, they are supposed to destroy the rest or take to local law enforcement for disposal. Many patients report they are turning the excess into edibles and topicals as quickly as they can, (honestly, I'm smoking as fast as I can) not realizing that the amount used to produce these derivatives is part of the 6 ounce maximum. Until DOH has the personnel to perform site visits, most of the patients who are deviating from the rules & regs think they won't get caught. Heard recently of a patient with a PPL who had 95 plants!!!! Diversion is the main concern of the DOJ. Since we have a supply shortage I doubt there is much diversion. Prices vary from producer to producer, so if there was enough medicine, I would be concerned about the price being lower than $10 per gram.
DOH is not currently accepting applications for licensed nonprofit producers. There are four companies with complete applications awaiting approval. I would say if you are interested, get all your ducks in a row and when they announce the open period for applications, you will have yours ready to submit. The more professionals you have on your board the better. You must have 3 patients on the board and one medical person (MD, DO, PA, NP). They have added a business plan as part of the application and I had heard but don't know if it was finalized, but they were talking about requiring a minimum capitalization of $150,000 like AZ.

mx120pro the short answer is NO.The producers can transfer to each other but that is it.There are some big shortages but DOH will not act to add more producers or add plant counts to the producers.Not sure about the numer of appications they have but I think it is in 100 range.
