Last night, the Senate, 93-7, passed the National Defense Authorization. I chose the Christian Science Monitor as my source, as it’s usually fairly conservative. If even these guys are worried about your sixth amendment rights, maybe you should be too. The upshot of this bill is as follows:

Legislation passed by the Senate this week and headed for the House – and a possible presidential veto – could allow the US military to detain American citizens indefinitely.
The National Defense Authorization Act covering $662 billion in defense spending for the next fiscal year includes a provision requiring military custody of a terror suspect believed to be a member of Al Qaeda or its affiliates and involved in attacks on the United States.
A last minute amendment allows the president to waive the authority based on national security and to hold a terror suspect in civilian rather than military custody. But the bill would deny US citizens suspected of being terrorists the right to trial, subjecting them to indefinite detention, and civil libertarians say the amendment essentially is meaningless.

And, as I read further down the article, I realized that for the first time, I agree with a Tea Party position without irony or snark.

This coming Monday, a tea party group plans to protest in Sen. McCain’s home state.
“When it comes to personal liberty and violation of every citizen’s Constitutional rights, Republicans are willing to take a stand against one of their own if a major mistake has been made,” says protest organizer Jeff Bales, a member of the Pima County, Arizona, Republican Executive Committee.
“‘Innocent until proven guilty’ is essential to our legal system and American way of life,” says Mr. Bales. “The Senate Armed Services Committee’s legislation violates fundamental values. It is unconstitutional and must be defeated. We cannot allow America to go further down the road of becoming a police state.”

Is today Backwards Day? Nope. It’s an astonishing opportunity for Occupy and Tea Party folks of Tucson to get together and set one, concrete, objective goal, and agree publicly not to deal with each other on issues of dispute. Imagine if these two groups, falsely set by the media as opposites, were to join forces in response to one violation of American rights that they both recognize. Imagine how the establishment would be freaked if the two fringe groups, that can be dismissed and set against each other, swallowed up the demographic pie-chart in a brand new color. Imagine how it would look in the plazas of America. Everybody looks good in purple.

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

There’s your Sixth Amendment, folks- and the implications of its suspension are horrifying. The first thing that could happen would be a wholesale sweep of Occupys across the nation, just ’cause they noisy & stuff. There are those who would cheer, and say “Yay, dirty hippies off my lawn!” But once that wheel is greased and turning, what’s to stop it from turning on Americans you agree with? Or you?

Let’s put aside all the ideological horse-hockey and come together to agree that the Government does not get to throw people in jail indefinitely just because it suits their agenda.
