TALKING POINTS
Here is exactly how RMLW2012 directly benefits Marijuana dispensaries and their staff:
--Specifically forbids or "enjoins" arrests for cannabis sales, cultivation or transportation, so long as you are in compliance with RMLW2012.
--The repeal of current felonies for cultivation, transportation, sales (etc), possession for sale (etc). That means no search, not seizure, no need for affirmative defense.
--RMLW specifies these are civil rights, instead of just affirmative defenses in court.
--Allows defendants to get their case dismissed without the possibility of a retrial. “All pending state court actions under said amended statutes which conflict with the provisions of this Act, shall be dismissed with prejudice.”
--Makes Federal raids very difficult by forbidding cooperation with federal agents or officials for cannabis raids, arrests, or prosecutions.
--Severely Restricts zoning and taxes by local cities and counties.
--Repeals more laws than any other initiative.
--Regulation goes to Dept. of Alcohol Beverage Control, which has a successful track record in regulating wine, instead of handing this over to the Department of Public Health which has already botched it's role in providing licenses to patients.
--The removal of marijuana, THC, and CBD from California’s Controlled Substances Act. Not rescheduling, but de-scheduling.
--Increased plant limits over the SB420 safe harbor. No more worrying about those immature clones, only mature plants are counted. If you are growing indoors you get 12 mature plants, plus those clones.
--Selling to a minor, or activities by minors in violation of the regulations are misdemeanors carrying a $2,500 fine -- instead of felonies.
