Great question as always. From the new CDPHE rules (effective 8/1):

"I. A primary care-giver shall not establish a business to permit patients to congregate and smoke or otherwise consume medical marijuana."
"F. A patient shall not establish a business to permit other patients to congregate and smoke or otherwise consume medical marijuana."

So the only people who can would be non-patient, non-caregivers. Makes a lot of sense, right?

I am left wondering if a business that was not 'established to permit' (ie charge for the ability to puff) can allow?

"establish a business to permit" says that is the business model. It seems incidental use not being charged for could be legal.

This isn't legal advice, but we have been involved in events with venue owners who are happy to allow smoking on the premises so long as only patients are smoking.

This is legal as it is a private event in a private location and patients are consuming their own medicine or sharing. We did not provide medicine at the events.

If you are wondering if you can set up a sort of reading room where people/patients can come to smoke, I don't know where it would fall in the law.
