    should I sue supervisor

    I was suspected of being high at work and failed a swab test, then was sent to a lab for a confirmation ua and of course passed. Can I sue the supervisor for defamation? Has any one had this come up before? I really think this bastard deserves a few problems. He nearly created one for me by the way the hr people are scared shitless and have suspended all ua until this is settled. I got credit for all hrs away at the lab, and was told that they made a mistake yada yada , and it would not affect my employment in any way. I laughed and giggled when they got the results 2 days later and had to pay me while suspended.

    IMHO advice is worth what you pay for. You might call a lawyer in your state and usually get a free consultation in person or by phone. Can post question for legal advice on AVVO.com: Let us know what you find out.

    In guessing: I would say, not draw unneeded attention to yourself. Courtrooms, etc. are stressful, as well and it can take years from your Free Life. Can you say, "you never touch MJ?" Certainly any previous use, may be a question you will have to answer. Sometimes, it is best to let 'sleeping dogs lie.'

    Certainly can understand your being upset over the issue. I would be too. However, if you haven't had a tug with the legal system in the past, you may want to weigh your options.

    Well I asked avvo and they haven't gotten back to me yet but I will see what they say. I was doing some reading about the subject at bunch of places online about creating a hostile work environment and it is my feeling that is what has happened. I am pissed at him because of making me look like a drug addict when all I do is smoke some weed sometimes, and he is pissed at me for publicly outing him as the jack ass he is and creating a bunch of frantic b/s for hr to deal with. It really sat the hive a buzzing if you know what I mean! I heard through a friendly supervisor that they flamed his ass and warned him if he did that again that he had better be 100 % sure or find a new job. Right now I'm hoping for an industrial accident to put him out of my misery.

    Hi Stimpy21; they usually take a few days, but they do answer. Sounds like you already got some satisfaction. Sometimes, that is enough. However, I'd ask for a formal apology!!! You deserve at least that and the admission that he made a big mistake. Preferably in writing, so you can post it! Good Luck, PR

    They did reply to me and They said I had no grounds to sue unfortunatley. Thanks for revealing that resource painretreat. I did however get a good deal of satisfaction knowing that he was flamed and had some tail feathers burnt, and according to a (unknown to him ) friendly supervisor he is now looking for a new job because he feels the company deserted him when he was following policy. Sometimes policy is WRONG!! So he feels rejected, lonely and pissed on and that makes me feel better.

    I would get together with some of the other employees and inform them what was done and see if you guys can't put some pressure on the company to clean there act up. Other employees were probably already erroneously fired because of a faulty drug test. Also a standard urine strip test is not a confirmation test. Strip tests are wrong all the time. It has to be GC/MS to be a true confirmation test.
