    Hiatt gets a not guilty!! :thumbsup: Some one will try to push this with adults you can bet. Or try and claim the need for an inordinate number of plants. But, it apparent that this very ill person needed that many.

    In a huge win for medical marijuana advocates, a southwest Washington man who grew cannabis for a dying cancer patient has been acquitted of drug charges.

    Mark Hensley of Vancouver, Wash., was arrested last year with 133 marijuana plants, many of them small clones between 1.5 to 2 inches tall, attorney Douglas Hiatt told Toke of the Town Friday afternoon.

    Hensley was growing the plants to produce cannabis oil for his former tenant, William Britten, who died of esophogeal cancer last August.

    Clark County Superior Court Judge Rich Melnick found Hensley not guilty on Friday, Hiatt told us.

    His client, Hensley, was allowed to grow more than the Washington's medical marijuana law's presumptive limit of 15 plants because it takes lots of cannabis to produce the oil, Hiatt said. "Mr. Britten used a significant amount of cannabis for appetite and nausea and to control the pain, obviously. He was very, very sick."

    "Mr. Hensley only had about 14 big plants," Hiatt told us. "At least 80 of those 133 plants were very small, 1.5- to 2-inch clones."

    Prosecutor Scott Icada was unsuccessful in his attempt to portray Hensley as a drug dealer.

    Hiatt, a Seattle attorney specializing in medical marijuana cases, is supporting a statewide initiative to legalize marijuana for all adults.

    This was a retaliation case which stemmed from other issues with vancouver leo...kind of da same chit they do to me...

    Tis how these yo-yo's are around here... rub them wrong and they just harass ya till ya move out of wa... been there done that multiple times..or they take everything, including the shirt off your back...

    Glad to see he won his case...not so sure how hiatt did it but, nice. FINALLY, and he had to do it my county after I filed a bar complaint on his ass...:wtf:

    It is wonderful to hear positive news like this. It is a shame that they target medical marijuana growers and patients.

    You would think they would be more worried about big street dealers who may be getting their product from and thus support Mexican mafia or gangs...

    It also sets precident (sp) of numbers of plants to make a given use method (oil) as oil does take a lot of raw product to make something that works well. For someone with cholesterol problems it is the best means to ingest orally.

    Very glad to see this and have saved a copy from the paper for future reference......

    I'll have to call Doug up and congratulate him.
    It appears though that there was no jury in this trial? That makes it even a bigger win for Doug. Its not very easy to prove your case before a judge only unless either you really made a great legal arguement or the judge was already biased towards medical Marijuana. Either way a great win.

    Since I'm looking to cheer up a friend on the forum....this is one case where size does matter!!! :lol5:

    If it was 133 3'+ ladies, we'd be seeing a different verdict I think. :twocents:
