So here's the situation:
Guy is taking a walk outside while smoking a J, and the J is put out when it's to the roach. As soon as it's put out and in a pocket a cop drives by. Guy gets paranoid, and slyly eats the roach when he sees the cop car drive around again and watches as it stops a little up the street.
So guy is walking right past the cop car, and the cop opens the door and steps out. The conversation goes like this:
Cop asks name, and address, which is promptly and politely given.
Then he asks why said person is out so late, and guy says im just taking a short walk and enjoying the air
He then officer asks "have you been smoking any marijuana" To which guy replies no.
The officer asks several more times "you dont smell that? i smell marijuana" and the guy replies "no I dont Smell anything." Guy then asks "am i free to go"? to which the officer replies yes. guy walks off paranoid into the night....

Question
Since the officer obviously smelled marijuana on guys breath, can he do anything about this, including come to the guys house, get a warrant, etc, anything?. At the time of the encounter guy had nothing illegal on him, just a rly stinky breath.
