CA grow laws and limits questions....

Ok so lets say you are drying your 6 or so pounds off your LEGAL GROW (in sacramento california the limit is 6 mature plants, about a pound off each plant) and for some god forsaken reason you end up getting handed a search warrant from law enforcement, the law here in sacramento specifically states you can posess 8 "PROCESSED" ounces....so what happenes when your whole 6 pounds is "PROCESSED"????

lets say this actually happened. chances are you would at the VERY LEAST end up having to defend your legal rights in front of a judge, and lets not forget, having to explain it to every possible employer that does a backround check, as an arrest does NOT get removed from your record even if the charges are dropped, or unfounded.

so finally, how would you defend yourself (legal rights) ON THE SPOT to prevent being detained??

sorry for all the hypetheticals, but im thinking this is not a uncommon situation.... so THANKS FOR ANY AND ALL IMPUT!

CA grow laws and limits questions....

The real answer is how much you can afford to pay an attorney. If you can afford an expensive enough lawyer and if you have a valid medical license they can get you off with any amount. For that kind of lawyer it costs about $25000 if you contact them after you are busted. If you give the same lawyer a $5000 retainer before you get busted they will still go to the mat and get you off for any amount of weed.

I know this is not the answer you want to hear. I have two licensed people at my house and grow 12 plants. Needless to say I got about 12 lbs of dried buds. For now I can't afford a lawyer at any price so I am pretty careful.

Your point is well taken. Essentially it is legal with a license but the authorities are fighting it anyway. By the way the Feds can bust you at any time regardless of your license.

The answer is very simple. The law says you can have 6 mature plants and up to 8 oz of dried prossesed bud. You simply harvest only what will end up being 8 oz at any one time then remove that 8 oz from your possesion and move on to the next harvesting. If you do not harvest all of it at one time you will be ok no matter what. (except for the feds as rudy mentioned)

I agree with all that rudy had to say. As for having 12 lbs and still not having money for a lawer I am very skeptical of this. Nobody I know has ever used 12 lbs for just two people for personal use. Even I would be hard pressed to consume 1/2 lb per month and I can hang with just about anyone smoke for smoke. (I'm assuming it is 12 lbs per year probably grown outside)

I do smoke about 1 to 2 ounces per week. This does not include the medibles I take that actually put me to sleep. If I get too stoned and forget to eat one of my medibles I end up tossing and turning all night.

It sounds like a lot but is not that much. Just an 1/8 per day with extra on the weekends. It takes a lot of weed to overcome pain.

Rudy, I have a better understanding now that you mentioned the pain issues and in particular the edibles use of your grow results. I have never noticed much of anything from the edibles I have tried from dispensaries. Have not made any myself but I can easily believe that it takes a lot of bud to get noticable benefit.

regards and good luck to you,

I can't ususally feel anything from any medibles I buy at many different locations. The two best I purchased at dispensaries are the rice crispy treats from The Patients Choice in Upper Lake and the Ice Cream Sundaes from MJ's also in Upper Lake. Even in these locations the other medibles are weak. I got the 4X brownie from MJ's and was warned to try only half. So I tried half and 1 hour later felt nothing so ate the other half and still never felt anything. Also The Patients Choice has recently changed ownership and I don't know is they still have the rice crispy treats.

If I eat a single one of my cookies I feel it as soon as 53 minutes. After 70 minutes there is the strong effect and you don't have to think about it.:stoned:

I make my own cannabutter using 2 oz of good trim with 25% tiny booger buds that are not worth trimming for each pound of butter. The last batch I made I used 8 lbs of butter and a little over a pound of weed with a couple quarter oz's of Chem Dawg tossed in for good measure. I cook the butter 22 - 24 hours so I guess it is much stronger than what most folks are using.

Purchased edibles are notorious for being weak. What we need in this business is a labeling requirement that would give the THC, CBD, and etc percent by weight. Because we don't, we get this "2 dose" reference and the problem is a dose for my wife (lightweight) and a dose for you will not be the same thing. Until we get a standard we will just have to try each and make notes on which is better and how.
The problem with overproduction is constant. Because plants produce more or less then we expect we have to grow more then we want to be sure to get the amount we need. The only solution I have is to be part of a collective or cooperative and be prepared to show that the extra was for other patients. That means (according to the one official that has responded so far) you need full contact information and a copy of the recommendation for enough patients that your total processed on hand does not exceed 8oz per patient. 12 lbs. will require information on 24 patients, you included. I will post more on this when I get a response from my county DA and the State Attorney General in the coming weeks. I personally am timing my grow so I have all the rules down and paperwork in place before harvest. Good luck with yours.
