How long should an app/proof of mailing be valid?
We're getting patients from January that are still using their application, proof of mailing, and doctor's rec to buy meds.
How long will it be legal to sell to these patients without an actual red card?
I am sure that they should have their card by this point.
If their application was never sent or was rejected how would we ever know? They can just continue to use their papers indefinitely.
The health department will not return calls with these questions... imagine that.
The recording on the CDPHE phone says that they are now processing July applications.
I'm thinking we might want to cut them off with apps dated prior to May.
Is there any means to validate an application in process??

There really isn't any recourse at this time. I've brought this up to Matt Cook countless times. We have no clue whether an app was even sent (you can get a certified mail receipt for anything), let alone if it was denied. As I said yesterday, we had a first time patient who submitted on Oct 1 who received their card on Saturday. That's roughly a month turnaround.
Legally, IN MY OPINION, you're not breaking the law unless you know they've been denied and still dispense. We only accept the physicians rec for one year after it's dated. Most people counted on MMC's/caregivers to submit their paperwork, but a lot didn't and pocketed the patient's $90 (or never paid for it after saying they would). We have a stack of slips with contact info for the CDPHE and recommend anyone that submitted and didn't hear back in the 35 days contact them.
They will return e-mails promptly, but you have to include your full name and last four digits of your social.
