    Hi Mimbres, I am new to the board. I see you have frequent feedback. I am working on an application for a collective. I have a set of bylaws and working on my articles of incorp. Do you have any feedback on finding a doc to join the board of directors? Would you be willing to share with me an application?

    I too am in process. One board fell apart and a new one was formed with new people. I now have a second Doc available. Maybe we could talk if you are still in need. I have a board meeting set up for sunday to fill out the rest of our docs. A look at other producer app would be helpfull. How can we get together?

    Im sure I can help you out, although I only have hard copies so we would have to meet up in person. I live up in mimbres valley *by silver city/deming*

    Although not to be discouraging I really doubt you guys have a chance, there are quite a few applications in before you would be getting yours in. I know someone who spent close to 40 grand and never even got a site visit, he had 5 of the approved producers application (this is someone not involved with the lawsuit btw). Having compared his application with the applications of people who had been approved I can say for a fact he got dicked over by the DOH. He had everything correct when comparing with other peoples application who had been approved.
    I often wondered if Dominick got a kick back from people to give them an approval, the lawsuit is really about disclosure of how the applicants are/were picked. I live close to columbus and the whole town down there is corrupt, I think the corruption goes all the way up north.
    I actually think the lawsuit is a good thing.

    New Mexico will need strong producers as our medical cannabis program grows.
    Don't waste you time one old proposals downloaded through the Freedom of Information Act. Left unchanged, what was a good proposal one or two years ago, has little chance of getting approved today - even if they where approving more producers right now.

    If you have the intent, required doctors, board members, resources and the guts to put it all on the line - by all means, do not hesitate! Put your money down and get in the game - New Mexico needs you!. If you are weak in any one of the areas mentioned, go back and try again until you have it right. If you have all of the elements and need advise on how to present your proposal, why not ask the folks who actually got their license and have been dealing with the ever shifting rules and regulations?
    Contact the New Mexico Cannabis Guild at info at NMMCPG.org I'm just saying, licensed professionals might have a leg up on how things really work.

    I understand what you are saying and agree completely. I will be in contact. Thanks. But BTW I spoke with Donna in SF today and she said that the rules are and have changed again and any incomplete app will be flat out declined, rather then the old way of holding a file until it is complete. SHe went on that the new guidlines/criteria will not be available until Jan 1. So the people who have submitted will be required to resubmit in Jan 2012 when the new guidelines are released.

    Not to be disrespectful, but Dominick and the DOH are not Richardson! I can assure you that the producer I work with gave no such payment to anyone. In fact, some people kept saying they should offer one. That would have been the quickest way to have their proposal disappear! The people in this program are good, honest people and any inference otherwise is just wrong.

    Yes, there is a lot of corruption in the Deming/Columbus area as is being reported in the news. That doesn't make everyone corrupt. There is no "pay to play" with the DOH. They are truly trying to do what is right by the program. There are rules that must be followed. Without rules, we would be attacked just as the other states with MCP laws who do not have as strict of rules in place. We need to work within the rules and regulations and follow the rules to request any changes. And, believe it or not.....I hate buraucracies (spelling)! But, I believe in following the rules rather than trying to find a way around them. Some people think they can and no one will know. That may be true, but once they are discovered, they will lose in the end.

    My friend had copies given to him by other producers, at the time they were not old in anyway. now they are outdated, but at the time they were applications which had been recently approved by the DOH.
    thats why I think its a good think the DOH is getting sued because when you looked at my friends application, and the approved application (all of which were only a couple months old at the time). there was no difference. but the DOH said he was missing certain things in his application but his application was the same as the applications of people approved.
    Im pretty sure the DOH is going to lose the lawsuit, when two applications have the exact same info and are submitted within a couple months of each other. The rules to become a producer had not been modified in anyway(in other words, the requirments were the same nothing had changed when my friends application was sent in..)

    SOO...When one person is approved and another person is failed but the info contained in the applications is the same, there needs to be some disclosure on how applications are picked.

    Agreed, MOB. MV...my thoughts on this would be that if they were "identical" then DOH may have interpreted that to be that it could be a disguised secondary location for an already licensed producer and they aren't allowing "satellite" offices. Or perhaps all of the board members weren't in place. That has been the biggest obstacle that I have heard....people submit their app without everything/everyone in place and ask for approval and THEN they would get all the patients on the board. Know what I mean? Without seeing the proposals Side by side, it is only speculation on my part. When the app fee was only $100 they received a lot of incomplete applications. Since they didn't have a means by which they could just outright turn them down, they continued to ask for additional information. That is why they instituted a lot of the changes last December. Have you seen how much Arizona wants to charge for their producers? Yikes!!

    Additionally, just to remind everyone....there have been no applications "denied". They are all still pending. Even if there has been a site visit, that doesn't mean there is approval. I am hearing that the increase in plant numbers has had a saturating effect currently. I don't know why, but one of the producers in the Farmington area has closed its doors. So sad. But, before any new ones are approved, it has to be demonstrated that there isn't enough medicine available for the number of registered patients. 25 producers. ~ 5,000 patients. That is basically 200 patients per producer. IF the producers are growing properly, then there should soon be a substantial surplus and the prices should come down soon as well. But, until the patient numbers significantly increase, law suit or no law suit, there aren't going to be any new producers any time soon.
