If hiatt don't get the 1st case dismissed under the fry case decision, he needs to retire...simple motion to dismiss as a matter of law. I honestly think my 11 yr old could prolly write it. It is that simple of a motion.

The court or state would have no lawful choice but, to dismiss. It is the presentment after being charged with a crime, not upon arrest.
