Its the nature of the law. Because MMJ is not legal, it only allows for an affirmative defense. The legislature could fix it overnight if they wanted to but by having more nonviolent cases in court it makes a good arguement to keep funding the thug judicial system.

And this will not end, no matter even if the intiative gets passed you'll still see officers arresting patients because they'll say they're following the federal laws.
