Going to trial would not be prudent for a patient attempting to bring any defenses since the authorization is void on it's face...not conducive at all. Plea to a lesser included charge is the only way out for the patient being one has no defenses....

So the answer to this specific case would require a big huge no...appeal the courts ruling is the way to even attempt to begin to fight the rulings herein..

Motioning for a new trial is not in the way the courts work in cases like this one...you of all people should know this justpics.
