FRESNO, Calif. -- Fresno County lawmakers have passed an emergency ban on outdoor marijuana gardens that they say applies to residents with doctors' recommendations to grow and use pot.

The county Board of Supervisors said it approved the 45-day ban on outdoor cultivation Tuesday in response to a series of violent confrontations between homeowners with backyard pot plots and marijuana thieves.

A Fresno man was shot and killed last week by a medical marijuana patient who suspected that thieves were raiding his crop. Police Chief Jerry Dyer says shots were fired during two other similar incidents this month.

County Counsel Kevin Briggs says everyone growing marijuana in unincorporated parts of the county will have to relocate their plants while officials draft a permanent ban. He told the Fresno Bee that medical marijuana patients can grow their plants indoors

This is such a knee-jerk reaction that it's not even funny. I live near and work in Fresno. My dispensary is in a Fresno County island. The problem is when people grow a 10ft tall plant behind a 6' tall fence. You have dozens of plants that are sticking up 4' above the fence. What the hell do you think is going to happen? The shooting near Roeding Park was unfortunate, but please! If you are dumb enough to grow 10' tall plants behind a 6' tall fence across the street from the central valley's largest and most popular zoo and park, you can't complain when you draw everyone's attention. There is no way of telling how many cannabis users drove by this man's house and saw the plants over the fence. I think it would be safe to assume several thousand, before some idiot decided to try to take what didn't belong to them. I think both parties share the blame for the shooting.

I saw a picture in one of the local papers and I would have to call it an attractive nuisance. These guys are idiots. I have a good friend that works for Fresno PD and we talked about this on Sunday. He said that all the officers knew where it was at and were actually taking a few sidebets on when this would go down. I don't think they were necessarily planning on a shooting, but they knew the place was going to be hit. The court case should be interesting espescially since the property owner/shooter was confined to a wheelchair.

A friend of mine shot an AK wielding felon escaping from the police who was trying to jack his car at gun point and he got put through the ringer.

If you shoot someone in CA make sure to drag them into your house before the cops arrive. This will make your trip through the ringer a lot less painful.
