Firearms and possession question
I was thinking of a hypothetical today. Suppose SWIM had a roommate who was growing a felonious amount of MJ (1 plant, even). SWIM owns a home defense shotgun, NO other uses (gun range or locked up). SWIM also partakes of the essence, and would have his/her own (misdemeanor) supply. Should the police have a reason to come a-knockin', where would SWIM stand? SWIMs concern is that the gun ownership would greatly aggravate the charges, even if SWIM wasn't involved - whatsoever - with the cultivation of illegal plant matter. This, hypothetically, would be in the great state of Georgia.

It will be up to the prosecutor if he wants to file a firearm enhancement to the manufacturing charge. Anyone in the house can be charged with it.

anytime a gun is present and a felony is be commited...it normally hightends the charges ...meaning a stiffer penalty:
Everyone in the house usually goes down...then charges are pressed on the owner or personal on the lease
Friends of mine got popped..he had 4 other people over sitting around at the exact time he got popped..everyone went to jail who was in the house
Friends were never charged..but they held them overnight

I am not an attorney but my advice for them would be get a good attorney that specializes in these kinds of cases, spend as much as they've got to get the charges reduced as much as possible. possession of a firearm during the commission of a crime is often a crime, too.
even med user's in legal med state's are not exempt from that, according to the ninth circuit. :wtf: makes no sense to me either ... we seem to be the only group forced to give up our second amendment right.
but, with only one plant maybe they have some hope if its their first offense.
if they are in one of these counties this guy sounds pretty good. :twocents:

or if this is just all hypothetical then my advice would be get rid of either the shot gun or the plant. its not worth it. :twocents: just get a really big stick that's what I have. :jointsmile:

Yeah, all hypothetical currently. I bought the shotgun because it's a rougher area we're moving into, and don't really want to give it up. Much prefer to ditch the plant, I can buy trees. Thanks for all the advice, I'll probably end up contacting that lawyer soon to see what he says.

Talked to the lawyer you posted, boaz, and he echoed your's and G13's advice. Going to have a house meeting once everyone is settled and figure out what goes and what stays, thanks all for your advice!

Yea i am kinda of confused about the laws surronding Firearms and MMJ. I have a concealed weapons permit. Is it illegal for me to carry my Legal MJ, and my Legal Springfield XD at the same time????(in Washington State that is)
The way people like to treat gardeners in this state, i feel like i need my guns in order to protect myself.
