Matt Cook Questions 7/22/10


Apply before August 1, 2010, get a license back when? July, 2011

*If you want to be an MMC, OPCO, or IPM, you HAVE to apply with the STATE prior to 8/01/10.
If you apply August 30th, when can you make your first sale? 7/1/2011


How long will that last? 1 Year, ie until July 1st, 2011.

DOR considers employees and managers to be licensees for the purposes of the 2 year residency requirement and felon restrictions.

Employee applications and IDs will be available next January of February, but he expects you to follow the rules right now.

Contractors? Plumbers, electricians, ect are allowed in the restricted access areas but need to be accompanied by an employee.

Trimmers? HAVE to be employees. Plants have to be trimmed in the same location they were grown. No taking plants into the general areas after hours and doing the trimming there.

Only 1 IPM per location? Yes. Ie. NO RENTAL KITCHENS. Multiple kitchens are allowed, but each licensed.

Step up licensing for MMCs? Yes. You will be able to ??step up? mid-year but will have to pay a minimal extra cost.

Relationship between MMC and OPCO? Mutual ownership is REQUIRED. Yes required. No Minimal percentage. Mainly, the grow company needs to be added as a member of the MMC.
-Lease? The MMC needs to be the name on the lease of the grow. But, if the grow is a member of the MMC (see above) then there wouldn??t be a need to sublet.


How to figure out your primary MMC status from now until? Bug the crap out of CDPHE.

Franchises?
Multiple MMCs w/1 OPCO? NO. Different OPCO for each store. However, a building can be divided up with multiple OPCO??s.

How to display ??products used in creation?? ON EACH DAMN PACKAGE. Yes, if you sell a patient a GRAM, a sticker needs to indicate what was used in manufacturing the product.

*He intends to require lab testing of ALL products in the near future.

Transfer of ownership under state rules? Not in effect until July 1, 2011. Local rules apply until then.

How will Aurora work? Can submit and process application. Might move timeline in January 2011 when the legislature takes session.


Conifirmed:

Include a letter if there are items you have not been able to obtain yet.

Patients can shop in any mmc but can only assign growing rights to one.

18-21 year old PATIENT ban? No. Only employees.

Affidavit for 70/30? September 1, 2010 ??necessary for operation of business?

No limit on OPCO associated with a IPM.

$5,000 bond? Only applies to MMC.

What??s the deal with Hash/Keif?
-If water, ice, screens, are used in the production, this is Medical Marijuana and NOT and infused product. It??s creation does not require an additional license. It can be sold as a item not intended for smoking.
-If alcohol, butane, or other substances are used in the production, this is an Infused Product and a separate license from the state and a commercial kitchen are required in the production. These items are not intended to be smoked.


Purpose of release? ??The DOR investigative staff needs to access to these accounts and documents to determine suitability of the applicants and nothing else.?

Is ANOTHER state license fee coming? YES. Depending on the cost of the program and the number of applicants, there might be an additional License Fee come July 1, 2011.

Credit card point of sale is in the dispensary. No internet sales allowed.
