As usual you are correct.
However I think this is related to the question.

Can an acupuncturist serve as a board member for a growers application?
I appreciate the info. I got from everyones responses. Thank you!
I do feel that it would only be fitting for doctors with herbal training to be allowed on the boards (naturopathic docs, acupuncutists, homeopathists etc.) MD's aren't trained in herbs, but since marijuana is harmless they won't be causing damage by thier lack of knowledge at least. It's good to hear that a chiropractor has been approved-- there is hope that other holistic docs may also get approval:thumbsup:. It may take work to break ground for it though.

Can an acupuncturist serve as a board member for a growers application?
I have a group of business men I ride with (Harleys and one communist that rides a Gold Wing) One owns 4 Health Centers in Tucson which sell vitamins and organic foods a retired Chiropractor he is in favor.
One of his ex-partners is a Chiropractor and a Naturopath MD (which is really rare) he does agree their is medicinal benefits. He does lectures around the world and anyone that keeps their Naturopath license once a year has to submit a study which he decides if it is a pass or go.
Unfortunately he says he would not recommend it for anyone he would go with other holistic methods. In his clinic there is an acupuncturist which I have used for a dislocated shoulder I believe he is in favor.
My Chiropractor which I referred to as my board member is in total favor and the reason he was willing to be a board member.
So not all natural healers are in favor just like any other profession it will depend on personal experiences until the stigma goes away.

Can an acupuncturist serve as a board member for a growers application?
So the question becomes: does the State of New Mexico Dept. of Health consider an accupuncturist a "health care provider?" :wtf:

I suggest the [email protected] to follow the chain of command before going to the top. Personal experience it takes longer to get the director to answer I am sure he is very busy.
Some days they get back within hours some times within days. You must realize your dealing with a overwhelmed government agency so patience is a virtue.

Hello again,
First let me say thank you for your quick response. Second I have some additional questions as I read through the requirements to establish economic feasibility, and license privilege vs revocation.
1) Are public dispensers allowed or is the product to be delivered directly to the patient?
2) Is it wise to have a dispensary if it is allowed? I am afraid the Federal Government may construe this as blatant disregard or flaunting.
3) If a dispensary is allowed (wise) can the production and distribution be at different locations for additional security?
4) Can a producer sell product to other producers/dispensaries?
5) Can a producer also sell supplies for home growth such as light and hydroponics equipment?
6) Can a producer give classes on growing for those who whish to be self-sufficient?
7) Can a home growth supplier sell seeds and seedlings to Medical Marijuana Patients for home growth?
8) Does the physician on the board (not one that prescribes or recommends) have to be registered and active in NM?
9) Can Chiropractors, also known as doctors of chiropractic or chiropractic physicians qualify as a â??physicianâ?ť on the non-profit board?
10) Is there a set ratio of producers to patients?
11) What is the current number of registered patients in NM?
12) What is the number of Producers in NM
13) Are the applications of currently approved producerâ??s public record that can be viewed with confidential information blacked out? The purpose is to use the methods as an accepted and successful model not for gathering information on the producer.
14) If a personal loan is necessary from a bank, private entity or individual for start up costs are they considered an interest that needs to be listed?
15) If the site location is leased does the landlord have to be listed as a business interest that needs to be listed?
16) Is an on-site finger print identification vending machine an acceptable means of distribution? Assuming prior documentation has been verified and documented in association with the finger print of the patient?
17) Does the state dictate pricing for product?
18) What is the current state tax rate on product?
Dear Mr. Anderson,
I will again answer the questions in the order presented:
1. it is up to the non-profit to propose safe methods of dispensing
2. you would need to consult with legal experts regarding this issue.
3. again, it is up tot eh non-profit to propose safe methods/facilities.
4. No
5. the regulations do not mention this.
6. the regulations specifically require information on how the producer will educate patients.
7. the regulations state nothing about seeds
8. the regulations do not specify.
9. the regulations state "other health care provider"
10. No
11. it is almost 1200
12. 5 are currently licensed
13. Yes, redacted copies are available for $.25 a page. there are currently 33 applications in process or licensed.
14. Yes
15. yes
16. The non-profit must propose methods, and evaluating them is a part of the review process.
17. No
18. it varies from county and city...please refer to local authorities for those rates.
The above are the answers number 9 was the answer. SO... I will go with the answer I received from them. Only because they are the licensing decision maker.

Yes I know DCs cannot prescribe drugs that has nothing to do with it. There are many "other health care providers" that cannot prescribe. If you still admittedly believe this then please quote it from the compassionate act.
With your reasoning if a prescription was necessary we in Az have already passed MMJ twice unfortuantely the wording was a doctor had to prescribe MMJ.
That is what stopped it from taking affect the last time as the DEA is the licensing body that gives doctors the right to prescribe. The DEA stated immediately that if you prescribe a schedule 1 substance and you will lose your license.

Thank you for sharing.
I think the question is misleading and your answer is both correct and incorrect at the same time... depending on the chiropractor.
"Health care provider" is a loose term the DOH likes to use. Don't be fooled by the use of this word.
If you submit a recommendation from a straight Chiropractor, it will be declined. Chiropractors can NOT write prescriptions for narcotic medications.
If you submit the same recommendation from a Chiropractor who is ALSO a doctor or health care professional that CAN prescribe narcotics, your application could be granted (depending on all other factors).
Again not picking bones, just trying to help.
I know because I submitted a recommendation from my Chiropractor two years ago, and it was denied.
