    i did not send my mmj application certified mail

    So I made the stupid mistake of not sending my mmj application certified mail, dose any one know what will happen to it now?

    Not ideal, but okay. The reason most people instruct you to send it certified is because they you can show a leo that it has been 35 days since you submitted your paperwork. The state has 35 days to approve or deny your application, and if they don't notify you in those 35 days, you're considered approved.

    Technically you can't make any purchases in those 35 days, though most dispensaries will still allow you in. It'll still get processed and you probably won't see a card for six months.

    So basically, use your paperwork at your own risk. If an leo wants to be a dick, he can (and likely will).

    I was told by Lauren Davis that according to Amendment 20 that a docs recommendation is all thats needed to avoid legal trouble even if one wasnt to send it in to the state. Anyone else heard this?

    I've heard that as well. It's the affirmative defense. Hell, I've heard a Dr's signature on a bar napkin qualifies.

    Yes--from what I understand there are people that do not want to be on the Colorado registry--for personal reasons--they can obtain a doctors recommendation--which is legal and opt not to be registered with the state.

    Heppa standards regarding one's right to privacy regarding their medical status.

    Would you feel safe growing for a patient that only had a doctor recommendation with no pending license? I have a few patients that only have the doc recs but I dont include their plant count in my grow because I dont feel like coffing up ten grand for an Attorney to argue an affirmative defense.

    Aern't you taking a chance by not sending for the card if you are stopped...don't you have to have the card to be totally legal ??
    I know I don't want to take any chances if I am stopped...is'nt red card security ??

    obviously not...it was probably a mistake for most of us to register with the DOH to begin with...the only one who matters is the doctor
