They get away with it until they sell to an undercover task force agent (example: Montana Pain Managment in Missoula). The reason they sell to any patient is they have so many cards that they do have huge ammounts of product over the limit.

As a patient, you are legal to buy from any source - as a caregiver you are only able to sell directly to your patients.
