Questions about Random UA's in the Workplace
Okay, so here's the situation/questions. I recently got a job with a Fortune 500 that has branches in almost every state and some overseas as well. They are a Drug Free Workplace, It says so on the door when you come in. I received my Policies and Procedures and the drug policy is stated as follows
Pre Employment
Post Injury- requiring medical attention
Post Accident- involving a company vehicle
Reasonable Suspicion- obvious
and
Random- When Required by the DOT..... All CDL drivers will be subject to.......
So I think I already know the answer to one of my questions but for obvious reasons, I can't ask either one at work.
Reading the above drug policy, would you, as a non-DOT employee assume that you were not subject to random drug testing? I am figuring the answer is Yes, because some states have laws prohibiting random UA's and others don't. It would therefore be hard to have different drug policies based on the state that business existed in.
My other question is, if there is a random policy in place would there have to be any more disclosure about how the policy worked? I thought I read someplace that there is something stating(possibly an article in the federal drug free workplace code???) you must disclose how the random selection is done. I will do more research and see if I can find anything...
Your answers, experiences and thoughts are greatly appreciated. I am stocked up with Quick Fix and ready to go if needed, but it would be nice to relax.
