    Stollen plants. Landloards fault

    Hi. My cousin had recently was living in a mobil home house. He had moved in with his girlfriend. She already was living there and had battles between the landloard. The landloard comes into there house, unexpectitley and walks around to check the place out. She then walks to the back room wich was my cousins room. shes sees that he is growing marijuana plants in there. Legal amount. 6 plants. She then gets angry and takes all his plants out and all his stuff that he and his girlfriend had in there house was takin out and put to the street. He had an expensive light and other stuff... my cousin wasnt home at thetime. at work. so he didnt know anything about what happend till he got off work. when he got home he finds all his plants are missing all his nuggs are gone. other people living around took them. What should he do. can he take this to court or does the landloard of permission to do that? also he has his medical card so he was able to have plants inside.

    I would think more about spending money on buying a trailer of your own or a real home vs legal battles unless your able to rep yourself in court then small claims really ain't pricey. Landlords suck but people who cannot assert their rights are asking for trouble if growing in a situation like that. Legal grow or not there is a risk of damage from growing in enclosed places, especially Mobile Homes so unless done properly as a land/home owner I wouldn't like it but would have handled it way different..

    as a former landlord, i can tell you that they ( landlords) can NOT enter a residence without giving the tenant a minimum of 24 hours notice, and if they do, it is considered by the law as BREAKING AND ENTERING/BURGLARY. if the grow was totally legal, your cousin needs to call the sheriff and report what happened, and that the landlord broke in, and stole your shit ( if they entered the house without permission and if they removed items from the house without permission, thats a felony bro)

    id be on the phone with the sheriffs office pronto and report it, then get alawyer to sue the bitch in court

    How can he find someone that can back him up in court to try and get money for how much the plant can yield. Can he even get money for that?
    Hes trying to get someone that can write a statement that can show how much the plant yields and get money for that. is that even possible?

    He/she can file on their own behalf and there are numerous cases where value is concerned with when dealing with loss of medicine. Should be no problems with getting that case going it just seems to take forever. Landlords just walking in is not acceptable. Asserting your rights and making sure your always in the right is important.

    yea, they have the right (MAYBE, depends on the law, and if you have a recommendation or not......some dr's (like my pain managment dr) will even write a legit prescription for pot ) to say you cant grow there if they know about it, but your not obligated to run them down and tell them either. furthermore, it doesnt make a difference if they "allow it" or not, they illegally entered a residence,removed valuable items from it, and ditched them outside. doesnt make any difference they didnt take them wit them, its STILL a felony 459 (burglery), period. as a tenant, you have rights, lots of them. the thing alot of landlords dont realize is that once you rent a property to someone, you relinquish any rights you have to entry,ect. my daughter had something similar happen to her awhile back ( less the pot though, her landlord used to sneak in her house when she was gone, and remove items, sniff panties,ect...no shit) and she did exactly what i told her, call the cops and report it as a burglery. they arrested the landlord and hes still fighting burglery charges in court, and looking at prison time.

    your cousins stupid if he doesnt call the police and report it as such. if he dosnt, he wont have a leg to stand on in civil court over the issue

    He had called the sherrif. They told him he couldnt do anything. it was a civil matter. But the thing is, is that the landloard knew already that he had the plants in there because she seen them before.My cousin said oh i have my medical card so im legal to have these. She said its fine. No were in the contract or rules saying that he couldnt have such things. Now shes saying she never knew he had the plants or his medical card. My cousin also said when she found out he had his card when he first moved in she also told him that she also has hers and showed him. So he can make it clear that she broke in and put everything out without a notice and that nite everything had been stollen. Now hes wondering if he can get like say each one of his plants yield 1p, can he get the money for each plants amount that it yields?
